Many people who have bought from Yes and many people who maybe considering buying from Yes Car Credit. We would like to warn customers who maybe considering buying a car of a number of very important issues. Yes Car Credit used to pride themselves on 'Complete peace of mind' 'Your loan is secured on your car not your home' You will of late, seen these assurances disappear from the adverts and sales pitch from Yes employee's. Why is that? There is a very good reason for this. As default on your finance agreement now, the likelihood is that Yes Car Credit with a little help from there friends at GoDebt (Geldards LLP) will issue you with a statutory demand and Bankruptcy proceedings. Something that does not appear in the Yes Car Credit adverts and sales persons script. Why Statutory Demands @ Bankruptcy? We believe that the main reason that Geldards are issuing statutory demands is economics. A SD must be responded to incredibly quickly - only 18 days to apply for a set aside or 21 days to "comply" with the demand. To set aside the demand a client must show that there is either: a counterclaim a dispute on grounds that are substantial there is security for the debt or the court is satisfied on other grounds that the SD should be set aside (things like the debt is subject to a judgment and enforcement has been stayed). To comply with the demand the debtor must: pay the debt secure the debt (i.e. a charge on the house) or compound the debt i.e. pay by instalments to the creditors satisfaction. (If the creditor does not accept the offer the SD has not been complied with and a bankruptcy petition can be issued). This means the debtor must respond quickly and in reality must pay the debt in full within 21 days or offer a voluntary charge on their house. Many people will be scared to death and because of the short time limit will pay up! Any that don't respond will be made bankrupt and are likely to lose their home. This is why Geldards are pursuing by SD as it is a very quick and easy way to get paid or get security in the form of a charge over a house for the debt. Many of the legal safeguards in the normal judgment and enforcement process are completely bypassed. It's quick with very high returns. Why don't more creditors issue SD's We beleive the main reasons why more creditors don't issue SD is that it is tended to be viewed as a last resort and as a harsh tactic. Banks and building societies in particular trade on reputation and so issuing SD for debts would clearly put off customers and affect business (as we beleive YCC and Geldards are discovering). So, If you have any doubts in your mind that you may not be able to fulfil your commitmets to a finance contract with Yes Car Credit for a 48 months period. DO NOT SIGN A FINANCE AGREEMENT! YOUR HOME MAYBE AT RISK IF YOU BUY A CAR FROM YES CAR CREDIT YOU HAVE BEEN WARNED!
