Chris, welcome to our forum. First of all how many months instalments did you pay? To repossess your car they would need a court order if you have paid over a 1/3rd for the car (excluding insurance payments). When they collected the car did you sign any paperwork.? You mention court. Have you had any judgement against you regarding this? You say you are having to pay back via your work being military. Now you brought the car when alot of the YCC contracts were "wrongly executed". That is they were wrongly written and most likely are unenforcable. There are a number of legal arguments against the YCC contract and most of them are agianst the insurances. As you have taken out insurance there is a high chance your agreement is unenforceable. Onee thing you need to do is get this checked out. If you go to your local CAB and ask them to contact thier specialist advisors regarding YCC they should be able to tell you if you have a case or not. The problem being in the military is that the welfare officiers tend to side on the 3rd party on matter like this and not on the guys they are meant to represent. Its a way of being in control of you. What they dont like is that they are bound by law and if you have a case where you have been unfairly treated then they could be in trouble. So lets see if you have a case or not, sort out DAF if you have then its up to you if you want to turn to your welfare man. |
