mis-sold insurance/ damaged car

Dear sir/madam
Further to our telephone conversation on the 18th dec 06, I wrote to
you to let you know that I wished to terminate my agreement as I can no longer
afford to keep the vehicle, the vehicle in question, namely a Vauxhall astra, reg
Y208 DOK, was in good condition and had been signed of the road .I was told on the
phone to cancel my direct debit and was told to ignore any phone calls/ letters as
regards further unpaid installments, and that you would arrange the collection of
the car to which there would be a collection charge of £80.00 . One thing I was not
particularly happy with was the fact that I supposedly had to pay around £800 in
insurances, which you told me was the optional insurance i took out at the time. I
would like to point out that at the time i was never told that this was optional, if
i was then i would never of agreed to it. Also upon receiving the car I was given a
cheque for a year’s tax, this bounced. Also within months of having the car I had to
have some quite major work done to it, i also sent you the receipt for these works
within a few days of our conversation and have yet to recieve them back from you,
these works included a cambelt change and a full service (£500), i thought this car
had been thoroughly looked over and serviced before it was signed over to me. It
says in my contract that I have to pay at least £4400 if I wish to terminate the
contract, and that i have to hand the car back,well ive paid over £6000. It took you
guys nearly a month to collect the car,but before it was collected, you sent an
inspector out to look the car over, i was at work at the time and the inspector told
my mother that the vehicle had been in a road traffic accident prior to me buying
the vehicle and that a few of the panels had been replaced, why was i never told
this beforehand? Anyway you picked the car up a week or so later. (but no charge?)

I thought that was the end of it, but last week i recieved a phone call from
“Golds” solicitors, demanding over £2300!!, i !

y queried this and was told that this was for damage that had happened to the car
whilst in my possession. Now before this car was taken away, it was up and running,
had been valeted inside and out, but yes it did have a few surface scratches down
one side, but the car was by no means perfect when it was sold to me. I was then
offered a settlement fee over the phone, i asked for it to be put in writing, but
was told it had to be paid straight away, to which i refused.
I
strongly feel that i was mis-sold the insurance, i have paid you over £6000 and
given the car back and have done everything i was originally told to do by you. I am
also aware that your company has appeared on Watchdog and i have visited the many
websites that are up and running dedicated to people/customers of yours who are in
the same position as me, who feel let down and lied to, i just hope that this matter
can be resolved.
