Subject Miss-sold PPI, and miss used settlement payment Message I was told that I would not get credit if I did not pay for "payment protection warranty and insurance" as It was called, despite being a serving Naval Officer on a 12 year comission, a situation where I would never be able to claim as I will always be paid in the event that I cannot work due to illness and injury. I also applyed for a settlement figure in August 2005 and after a month of stalling, I got fed up with them and cancelled my direct debits and sent them a cheque, a week later they called and said I had paid too much and was to receive a refund, which took 1 month to arrive. Upon reciept of the refund I called them and was told my account would be closed. In April 2006 I received a letter demanding more money, so I called them, explained the situation, they checked it out and told me that the account would now be shut. In October of 2006 after returning from a 4 month deployment I was met with a letter demanding a further £5000, this was confirmed when I checked www.checkmyfile.com. After speaking to Yes I was able to deduce that they had held the money that I paid in settlement and used it to pay my monthly instalment until it was used up. They had apparently sent me letters explaining a mistake on their behalf which meant I had infact paid too little and not too much but as I belived my account closed did not expect any further correspondance with them and therefor did not inform them of my new address, (I had moved with my job in October 05). In addition to this a direct debit was set up in September of 2006 by Yes, to start taking this £5000 from my account, this direct debit was not authorised by me, in fact I was in a submarine and therefore unable to be contacted for the whole of September. After discovering the direct debit had been set up I contacted my bank and was informed that if that direct debit was set up without my permission I was entitled to any sums taken to be refunded to me under the Direct Debit Guarantee, with that in mind I decided that in order to protect my credit ! rating I would continue to pay while the matter was being settled. I have e-mailed letters of complaint twice but have received no reply so I wrote a formal letter last week demanding a solution and a refund of my PPI, Yes claim they have not received this so I am sending a second copy by recorded delivery tomorrow. |
