Benw, welcome to our site.I feel you have 3 options to go for here: - 1. Although you brought the car in August 2005 I think you have a case for the car not being "fit for purpose". As you have had it tested 3 times and they still cannot find the fault I would contact Trading Standards on this on. Ideally you need to get an independant check on it. This way I think you might have a good case to get rid of the car for good. 2. If you just return the car you will be liable up to the half way mark plus the insurances. Unfortunately I dont think they will accept this as you have defaulted on your payments and they might remove this right from you. If they do that you might findyourself liable for the remainder of the balalnce. 3. Notive you have made effort to catch up on your arrears. If youwant to keep the car i.e. not have it repossessed, then this is a good way to go about it. I wouldwrite them a letter informing you intend to make up the payments. If it goes to court then a judge would lok at you favourable as you have made effort. As you are leaving the country for 3 years I can see how you are tempted to give it back. I do feel YCC/DAF will cause problems here for you as mentioned in option 2. As your time is short here why not give our legal experts Stephensons a call. They would be interested in geting you out of the contract and allowing you to keep the car. I say this as they would arrange for an independant inspection of your car. From there they would contest the car is not fit for purpose. Why not give them a call and have a word. Tell them you have been in touch with us.
