Stumbled across this site, but I think I'm glad I found it! Have a bit of an issue, and any help and/or advice will be appreciated. I'll try and be brief...

Bought car in Jan 2005. Made redundant in Feb 2005, and informed YCC. Took car back to YCC showroom, with a letter explaining I wanted to terminate the agreement and call it quits (it didn't follow your template, as I didn't know it existed!). I only made one payment, and cancelled the insurance (apart from Breakdown) within a week of getting the car, well within their cancellation period.

They sold car at auction for about 2k less than I paid. Was going through a painful separation and eventual divorce, so really didn't care, and I left my wife and home and moved away. Apparently, the debt was assigned to GoDebt in August 2005.

About 4 weeks ago, received a card from Kudos, asking me to phone, so I did. It's a tracing agency. Couple weeks later, received a letter from GoDebt giving me 48 hours to find £5700 odd. Spoke to National debtline for advice, and did the following:-

1. Asked for CCA and associated statements etc (paid a pound)
2. Proof that the debt had been bought or assigned to GoDebt
3. Asked for all info about me under the DPA etc

I received loads of stuff today from GoDebt, under 1, above, but they won't give me any info about the debt assignment, and want a tenner for the DPA stuff, which is fair enough. I've never seen the Notice of Assignment they refer to, nor any further correspondence from DFA/YCC after the date of auction.

I'm confused as to what I'm actually liable for. Under the CCA Termination bit, a figure of £4700 odd is quoted as being the amount I must pay to terminate. However, GoDebt is demanding £5700.

Which of these figures is probably correct, or is there a 'get out' clause as I terminated voluntarily???

In any event, I don't have that kind of money to pay, so it'll have to be monthly repayments...!

As an aside, within the reams of paper they sent me, were five pages titled Notes by Deal No, which have short-hand comments when I made contact with them. There are a lot of blank entries on certain dates, making me think they've been deleted, and the abbreviations they've used make it near impossible for me to understand what's going on. Can I ask for a proper transcript??
