Even if they could then you would be able ot contest the contract through the legal arguments we preach about on this forum. Fortunately for you they are not going to be needed. If they do make a move and thats a big if, it will be interesting to see what they do. They will most likely threaten court action hoping that will scare you. Perhaps you might receive an official court summons followed by a date for court. Whatever I doubt they will see you in court as they will most likely pull out. If I was in your shoes I would wait and see what they do. Then I would get your solicitor to write to them and point out the 5 year rule in Scotland. Also I would get them to get YCC to accept they have lost and that if they chase you anymore you will bring harrassment proceeding against them. Could you let us know who the actual debt collection agency is.
