Yes Car Credit

Hi,

I have only just discovered your site, I actually gave my car back to yes
car credit after 2 years as I could not afford the car anymore with a promise
that I would only owe £1,000. However they informed me that I owed them £3,000
and are still chasing me for it.I re-pay £20 a month they are threatning
court action where do I stand?

Exposing The Farce Of Daf/ycc To The Wider World

While there is a fantastic website that we contribute to , is it not time that the farce of the daf/ycc is again aired to the public who have not yet found this wonderful site and all the help that it has given everyone on here.
If we went public again maybe via watchdog as an update we could maybe help so many more poor individuals who do not know where to turn to for help


Any comments more than welcome,i am aware of the court cases going on my own inculded surley this can only help all of us , i will stand corrected if i am wrong

Shoreham Auctions

whilst looking for info about DAF and the 125 point checks they offered I have come across this from Shoreham Auctions (and it is up to date eg this year).

If DAF have set days for auctions of their cars then Shoreham must make a lot of money out of them. 60-100 cars is a lot of cars and just shows that really DAF have no regard for their customers - obviously repo's or just accepting VT's is the way forward for them these days.

From the end of April til the end of May Shoreham had 7 DAF car sales - yes 7!!!

Wonder what they have coming up this month?

Firstly, a well done to whomever set this site up. I came across it whilst doing a search proof of the lie I was told by YCC about AA checks when I purchased a car from them.

My Present situation is as follows:

Around 6 or 7 years ago i was working as a Rep in London. My car engine siezed up and I was quoted £800 - 1000 to have it repaired. I was n't the greatest rep in the world so the amount was out of the question. I was desperate as without a car, I had no job!!

I had seen the advert for YCC so went to a branch near me. In the end I picked up a car with a £500 deposit and drove away. It wasn't until later that day that I spotted a chip in the windscreen and a further one in the main light case. Alarm bells should have rung then but at the time I was desperate.

After a short period of time, I left my employment and defaulted on a couple of payments. I then took a Job in Holland to earn money for my family and to get my finances back on track. Unbeknown to me my sister rang me to inform me that 2 Glaswegian men had been round her house in Scotland looking for me and the car. I made contact with YCC, to be informed that they had sold my account to a debt agency!!

I contacted the company in Glasgow and offered to pay the arrears but they said it was too late. I had not received any court orders for repossession nor had anyletters from the debt agency. I am not one to be intimidated so I arranged to meet the debt agency guy in Edinburgh and duly did. I'm a big guy and the debt man felt very intimidated by me and told me once I had handed the car over that "This was the end of it as they were happy just to have the car back". No money was discussed and I came away happy with the outcome.

Last week however, I received a letter from a debt agency in Kent asking me to pay appx £8,000!! I immediately got in contact with a lawyer for advice and he said that due to a time restriction of 5 years in Scotland and 6 years in England that they were trying it on. He then told me to leave it and see if they come back to me...they duly did today in the form of a green letter.

I contacted them again and spoke to a very helpful young lady...until later on when her attitude changed :lol: I informed her about the time scale and she gave me the line of "Yes, that means that your credit record won't show the debt, but the amount is still payable outside this timescale". I then informed her of the previous dealing with a debt company in Glasgow and that I was told that the debt was clear, and this took her aback but still she pressed on that I owe.

I finally threw in what I consider to be an ace up my sleeve about being sold the car having been told that it had been AA checked and approved, and then finding out years later that in fact that YCC had lied about this. As far as I was concerned, their contract was null and void due to them lyeing about their product. At this point she asked if I had proof. I replied that it had been reported in the National press and would do a search for the details of this.

This revelation made her start to stutter and in the end she ended the call by telling me that I should get my lawyer to contact their legal team to sort this out.

My question is, Am I in the right here? Should I stick to my guns? and does anyone have a link to any articles about YCC admitting that they in fact did not have their cars AA checked as they advertised.

I can't believe my luck coming across other victims of yes car credit! having dealt
with them since march 2004 when my partner went to the showroom was made to wait 9
hours for 'credit' checks, then told the total price was £6,000 for a 3 yr old
punto, he was shown several old bangers and being desperate for another car due to
our family growing was exhausted into parting with our old car for £150.00 and
giving another £500.00 in cash to secure the new car, he wasn't told about the
insurances clause ect and went home in the new punto, tired but worried how we would
cover the £198.00 pm payments, we had no choice since privately renting our new home
and my partner starting a new job are credit was low due several factors! after 10
months the passenger seat runners stopped working and jammed, making it impossible
to move the passenger seat, we contacted the warranty company, who said we could
take it to the nearest fiat garage (25 miles away) and wait for a warranty
inspector to show up, it could be up to three days and even after his inspection we
could still be liable for payment, so we said no and did our own research and found
it would cost over £700.00!!!!! for new parts labour ect! and with a baby on the way
it was not an option. After 5 more months as i took my oldest child to school the
exhaust fell off, luckily i was near to a garage and it cost me £85.00 to fix new
clips to put it back on. we then decided enough was enough and took the car to be
sold at a local garage who said no we could as it belong to yes car credit until
we had paid the total, the car was unsafe and i worried driving it so we had to buy
a new car. My partner now took over use of the punto and recently drove it to a
business appointment and on his way back the engine caught fire and was totally
beyond repair. I called yes and told them i would stop paying for 3 months as the
engine cost £600.00 to replace and the money had to come from somewhere,so far to
date Ive been threatened with harassment through bailiffs and and phone calls if i
stop payments, Ive been told i have an attitude problem when i informed them i was
taking them to court, Ive been accused of being a liar when told by the warranty
company that my partner didnt ask for warranty cash back and wasn't entitled to it,
then in a further phone call told they didn't do cash back policies, the rep said she
would listen to the particular call i made regarding cash back, and call me back Ive
not heard from her since! I am now refusing to pay a penny more and they can take
the piece of rubbish they call a car, to date me and my partner have paid approx
£7,500 and have a further £2,000 in insurances, we have paid nearly £1000.00 over
termination price and the total for this car now worth 2 thousand if lucky and i
asked if this could be transferred to the outstanding insurances and was told they
were separate issues and could not be transferred! i will not give up and will take
them to court and have my day, trading standards are now taking up the case, if
everyone stopped paying these insurances and returned these heaps of trash back to
yes car credit then surely yes car credits huge profits would crumble, they may have
sold the car to my interrogated and exhausted partner but what they didnt count on
was having me to deal with, all i can ask them now is to 'bring it on' try and make
me bankrupt, i have nothing so they can take nothing and they cant make me
bankrupt or homeless as im a tenant!

Found an interesting piece in the Sunday Mirror yesterday on the "Judge Tread" pages. For you who don't know he is a motoring legal expert and normally people write into him about speeding offences etc.

However, somebody yesterday wrote in with a question about something which is dear to many of YCC's customers hearts (see link)

Experto Credite

Hi all.
Has anyone out there received a letter from Experto Credite this is not the 1st company who have wriiten to me.1st letter from red castle was going on for about 5 months we kepted asking them for the DAF insurnace never received this also many calls from them we had mentined to them i was going to report this to my solictor than this all week quite for about 4 months now today received letter from Experto Credite saying to do ignore this letter saying that they have noted that mail directed you me as been return despite the fact I appear to be contactable I ave never received any letters from this company.As anyone received one of these letters.It states that they are now taking us to court.

Are They Allowed To Do This?

hello guys I have been following this forum for a while and recently went to court against DAF. Basically last year we terminated our agreement with Yes car and returned the car. We heard nothing from them until we got a letter from the court telling us Yes car were filing a CCJ against us.

Long story cut short we defended ourselves in court were the judge stuck it out for the time been cause they had not filed the correct particulars of claim (basically they were trying to say we had defaulted etc when we hadnt)

The judge told Golds representative (who was clueless and i think he had only had the case given to yhim a few days before) that they had until the 24th of June to file new particulars of claim or claim was to be struck out. When they did file they we were to defend it again. We were to pay them no cost to date.

Well today we recieved a letter from a new solictiors who have taken over from Golds offering us a reduced settlement ie they want us to pay them £900 instead of the £1500. Now my thought is that this is breaking the terms that the judge has ordered and I wonder if anyone can advise.

Hubby and I are happy to go to court again as we fully believe like lots of people here we were mis sold the insurances on 2 reason. 1 my husband didnt have a permenant job so therefore wouldnt be cover (we can prove this) and we like everyone else were told we had to have the insurances.

We have never recieved any paperwork reguarding these insurances. The judge also told us that if they did file we should defend when or if they did refile and was telling us to look up things about recent rulings from (sorry if I get it wrong) OFT and FSA.

Wonder what your thoughts are. I hope this makes sense

Help And/or Advice Required

Hi,

After hearing nothing from DAF for 15 months and them not responding to my letters i wrongly assumed they have finally stopped harassing me - until today.

I came back from my lunch break at work to find a message to call an enforcement officer back - rang her to find DAF are filing a bankruptcy order against me?? I asked on what grounds - she replied non payment of debt.

I sent my vehicle back to Yes Car Credit in Feb 05, i needed to change my vehicle to an automatic due to an accident at work, they wouldnt let me. The clutch and gearbox needed replacing in dec 04, i had not even had the vehicle 1 year at this point. i sent letters in etc - none were responded to - in the end i had to pay for the works to be carried out (so much for mechanical breakdown). I was also told when i got the vehicle that i had to take out payment protection or leave without the vehicle.

the enforcement officer says i owe £3500 but they will accept £1700 to clear the debt (not in a position to do this), i am currently in the process of buying my council house so getting a call saying a bankruptcy order was being lodged against me absolutely petrifies me. Also as far as i know bankruptcy actually forces me out of my profession of accounts, qualifications down the drain etc.

the enforecment officer has said she'll accept £75 for 3 months - at this point they will advise of settlement figure and this must be paid up at that point.

Any advice that anyone can give me would be greatly appreciated.

75% Discount On Ppi Payment?

Hi all,

DAF decided that they wouldn't accept our payment scheme (the original monthly payments) and said that our case was being dealt with the legal dept. Last Thursday/Friday I received a txt message from DAF asking me to call them with a different reference number.

As usual I ignored it. They tried calling my mobile this morning and I never answer anonymous calls, so I ignored that. As I was listening to the voicemail they left the house phone rang and it was DAF again.

After I told them that we're waiting for the legal dept to get in touch, he offered me a 75% discount. So instead of paying £1900, it's now down to £476.69, I told him I couldn't afford that right now, and he then said he can do it over 2 payments.

I've taken his arm off just to get rid of this crap.

Wise choice?

On the 26-04-06 i purchased a car from yes car credit i was told i had to take out all the relevant cover PPI/Gap Ins/mechanical breakdown.This all totalled to £13,325.76 with finance the car came to £9,023.04.
34402.72 was all the cover i had to take out. In july 06i gave then the car back and the balance was £6735.01 left to pay.
I recently found out this is only the insurance covers i have to pay back i am wondering if their is anything i an do i don't see how i have to pay for this as i no longer have the car
I believe i was miss sold the insurance covers.
The company phoned me up saying i owed this balance and they would reduce it by 50% if i was to pay straight away.I don't think i should pay anything as i was miss sold this.
Can anyone gove me any advice on what to do?

hi there first of all wot a fantastic site

anyway my problem is i got a car from ycc in august 2005 the car has had some sort of a problem since the word go (it bunny hops and sound terrible)we have had 3 dianostic tests all say something is wrong but can not pin point but this is not my problem

my problem is i am in the army i have been in afgan since late dec 06 i have only been back 2 wks was informed by my bank that the derict debit has not been payed since jan 07 i rang daf to sort the arrears out but they just hung up on me

while i was away the camp i was living in was knocked down so daf does not have my address so i have not had any letters when i rang they just told me they where not interested and hung up not sure wot 2 do i am supposed to be leaving the country soon for 3 yrs i have to admit i am tempted 2 take the car 2 one of there auction house or offices and just leave it there

what should i do please help

also i do not have all the money still in the bank have most of it but this was not the only direct debit stopped so i have had to pay them and there charges.

Help Needed Gone To Debt Collection

Hiya all I am needing some help as we have followed the processes from your site and asked Yes to accept termination at the 2 year mark. they seemed to accept this and we had a letter through 2 weeks ago asking us to arrange collection with their Birmingham Auction company. My wife rang them to collect and was told that Yes had cancelled the order to collect our car. Now we haver just recieved a letter stating that we have arrears of £963.35 and that this is being passed to debt collection. We stopped payments after terminating agreement and were waiting for them to collect. What do we do now? We are concerned that if this goes to court we could be ruled against or is it fact that courts are looking unfavourably against DAF? What we want to do is hand the car back or even let them repo it... We are also accumilationg charges amounting to about £50 per week with there computer generated letters. I do not have any problem with asking them to refund these it's just that my wife is worried now that it has gone to debt collection.

Could someone please give us some advice as to our next move against DAF?

It's great that people are making a stand against DAF...

I have received a letter this morning, from yet another debt collection
agency. i got a car in feb 2003 i had just gotdivorced,ihad no where to live so i
moved to america with my mother. i rang ycc in luton explained the situation,
they said take the car back i might have to pay a fee of 200 pounds but that
would be that. i stayed in america for roughly 4 mths, last year i got a
letter off a company called bdr . they claimed i owed ycc £6301.55 i rang them
told them exactly what im telling you, they still said i gotta pay . i
contacted a solicitor they told me too write to companies house under the
harrassment act. i rang bdr back told them this and they backed off. then today i get
this letter off another company called marlin, now there threatening a
charging order against my house. as i only had the car three months and paid £1200
for it and gave it back in better condition i think this stinks. as ive now
got a mortgage with my girlfriend i dont know what to do, it was nearly 5
years since i got the car i have moved a few times i dont have the paperwork any
more. could you help please.

hello

I had a car fro YCC about four years ago.

I was not happy with it as it constantly went wrong and in the end the head gasket went after 3 months!

The car was taken to a garage and "verified" by a YCC engineer who said that the warentee did not cover any of the faults. I refused to budge and they took the car back without my authority. I had not paid the first 1/3 of the value of the car and ceased payments.

I have written to Thames Credit Limited (who are chasing the debt) and asked for all documentation relating to this.

Please can you advise who would be best placed to advise me legally?

Hi i am new to this forum, did not realise there were so many problems with ycc. My husband and i bought our car from Southampton branch in May 2005... All has been ok until a month ago. I was accelerating from a roundabout when there was an almighty bang from under bonnet. This scared my daughter of 2 years who was satin the back. I managed to flag a friend, who then started engine and plumes white smoke came billowing out. I arranged for a garage to tow the car inand after a few hours i was informed that i ws looking at a bill of £1500. Apparently a Heater Plug had more or less blown out. I asked how this could have happenedand they said that on inspection of the Heater Plug, it had been put on cross thredded. and closer inspection, it looked like it had been put on with a Windy Gun. The last people to look at any part like that on the car was YES CAR CREDIT. but i am sure we have no come back on them, because of the timescale.

Also my husband and i want to change our car but not sure how to go about it.


My Car Taken With Out A Court Order

some years ago i purchased a car from daf, only to fall behind with the high re payments the car was taken back with out a court order.

years later they got in touch asking for 3500(this figure keeps rising)! i dont know were i stand and dont know if we had even payed over one third of the overal cost i do now the amount there asking for is all i had left to pay on the agreement, so what about the cars value they had taken back why was in not deducted from the amount owing!!! banghead

Hi,

I got my car in August 2005.
I was in full time employment.
I was told I could not get the car unless I took those insurances out.
I have paid every payment of £196.31 and only had one letter costing £15.00 as I had no funds in my account in June 2006.
I have had no problems with the car apart from squeaky breaks. Although they were like that when i got the car.
As I am Hard of Hearing my mum has been speaking to Stephensons on my behalf about the PPI but we have not heard much on that front.

I am aware I will have to carry on paying the £44.00 odd insurance but I would rather be rid of the car and the payments (plus petrol et al) so I am prepared to carry on paying that.

I have been looking forward to this for months but after reading some posts I am a bit concerned there are going to be problems.

Am I right to be concerned? I just want rid of this burden.
