Yes Car Car Credit advertise as shown in the links below and inform customers that the loan is secured on the CAR and NOT on the HOME. Please can anyone help me as go debt have been chasing me for about five months now, since yes car credit passed their debt on to them. I purchased a ford escort estate R reg in may 2003. Older than advertised as the salesman who kept me waiting for ages only asked me how much could I afford. No vehicles in a shabby back street yard had any prices marked on them. I was paying £201.44 a month for this vehicle. In may of 2004 my family credit stopped because they said they paid me to much the previous year. so it left me with little to spare. I contacted YCC on many occasions telling them of my situation.I did write a letter to direct auto finance to let me know where to return the car to because of my situation and not having a address for YCC.I never got a reply. Then I managed to get a second job in august, but it was monthly pay,I also told YCC this and pay the two months arrears on the day I got my monthly pay. A week before I was going outside my front door to work at 07.15 hours and I find to very large burly men waiting in a van. They got out and said they have come to repose the vehicle, I had no repossession letter and no phone calls to say this was happening. I gave the men the car keys as they looked intimidating. According to the credit agreement if I paid over £2,300 plus YCC couldn't the car without a court order, but I paid over £2,600. I took this to a solicitor who charged me £300 for initial advice saying I had a case. But Go Debt told my solicitor that the amount stipulated in the agreement was for the vehicle only, not including insurances extra, But it doesn't stipulate in the agreement. Go Debt continued to harrass me for a while, saying that I will be taking to court and made bankrupt and baliffs would be round. Then they stopped harrassing for a while. Two weeks ago a infamous telemessage came through the post telling me to ring them. I did and agreed on a payment of £50.00 a month which I can't afford at the moment, but they wanted more saying it wasn't enough, they wanted at least £100.00 a month. In my opinion I've been conned by YCC, my solicitor and GO DEBT. Please can you give me any advice as soon as possible. |

It is Godebts interest to accept any amount of payment from you. If it goes to court this will be more expense and time for them. Plus when it gets to court you can advise the court your incoming and outgoings and they will normally accept what you offer as a payment. |

As others have stated, we have been told we will be made bankrupt and our property would be at risk should we fail to pay up. When we tried to negotiate payment terms with them, they were unwilling to budge insisting on the full amount immediately. They also didn't care about what Yes Car Credit had or hadn't done, in our case, the refusal to honour the warranty, and the refusal to collect the vehicle. I now see that what Go Debt are doing is illegal. I think I shall be contacting the OFT about them. |

Make sure you do complain. Anyone else in this position must do the same. Important ! Any Yes customers who are in the position of returning the car back half way through the finance agreement and have the issue about having to pay for insurances for a further two years. Contact the OFT and put the complaint in writing to them ! |

Hey there, Had a letter through from Go Debt today - never even had any notice from YCC about "Outstanding Insurance"! I returned the car in May ending the agreement, not once missing nor being late with an instalment of £296.19 every single month for 24 months - one would have thought they would contact me first before handing me over to GO Debt. So..... I called Go Debt offered them a payment of £100 a month until I have payed the £2000 outsatnding insurance, They refused told me to "go borrow some money and pay £2000 or else they will issue a statutory demand" - WHAT TO DO? |

When Godebt are telling you that your home is at risk advise them to take a look at the following Yes Car Credit advert (one of many) where they clearly state the following : Tenants, self-employed and armed forces are welcome. Typical GoDebt. If you offered some sort of payment I doubt they will take you to court. My immediate advice is go straight to the CAB who will handle your debt. Then report GoDebt to the OFT. They seem to be breaking all the laws of how a debt collector agency should behave. I will be starting another forum soon regarding how these agencies should act. Just bear with me until I have all my info. From what I've seen so far GoDebt are not playing the game. |

You might find this info regarding Statutory Demands Useful: Statutory Demand A statutory demand requires that the debtor either: Pays the relevant amount Offers to secure it against property Offers to repay the debt in a way that is satisfactory to the creditor. For example, by instalments. Some creditors use statutory demands as a way of persuading debtors to pay off the debt, usually by borrowing elsewhere. However, statutory demands should be taken seriously. After 21 days the creditor can petition for a bankruptcy order. Therefore, it is usually worth contacting the creditor by telephone and asking them what their next step will be. Ignoring a statutory demand may encourage the creditor to petition for bankruptcy. It is worth bearing this in mind, particularly if the debtor is contemplating petitioning for his own bankruptcy. If the debtor wants to avoid bankruptcy he should consider: Making payment(s) to reduce the debt to less than £750; or Making an offer to pay by instalments; or Making an offer of a reduced amount in settlement of the debt; or Applying to have the statutory demand set aside Setting aside a statutory demand. 21 days after the serving of the statutory demand, the creditor can petition for the debtor’s bankruptcy unless it has been ‘set aside’. An application to set aside the statutory demand can be made if: There is a substantial dispute about the money owed; There is a counterclaim of more than the money owed; The creditor holds security that equals or exceeds the debt in value; On ‘Other Grounds’. Though not defined, these can include: The demand was issued in error, e.g. for a secured debt or for an amount of less than £750; Execution has been stayed on a judgement; The debtor is complying with an instalment order (so the debt is not strictly due); and The creditor failed to comply with the rules and prejudiced the debtor in the process; An application to set aside must be made with 18 days of the statutory demand being served. Forms 6.4 (application) and 6.5 (affidavit) must be completed and taken to the court. However, the court can dismiss the application if there are no grounds. If there are grounds, a hearing will be arranged at which the court will decide whether the demand will be set aside. If the debt falls under the Consumer Credit Act 1974, the court should also consider if any relief is available to the debtor under the Act. This would include a time order application. |

Did I mention that the two burly men who waited outside my house at 07.15 hours on 7th Sept 2004 did in fact repo the car, what else could have I have done, they looked intimidating. Go debt stipulates that I owe them £5,740.65, most of this is the insurances YCC said I had to have. The car actually only cost £4,400 which was a lot for a R reg escort two years ago. I already paid over £2,600 towards the car before they repossed the car. I've been to the CAB and solicitor. Go debt told my solicitor YCC had a legal right to reposess,but the agreement with direct auto finance says different. |

Anyway - Yesterday I was not allowed to speak to a manager at all - it was either pay the £2000 or we freeze your salary and list your property. not even possible to negotiate ANY instalment terms. Well this morning armed with knowledge from the OFT, I called again quoted several paragraphs from the OFT Guidlines for Debt Collecting, guess what, I was transfered to a manager within seconds, and suddenly the tune changed. Wel now suddenly I dont have to settle the full amount and I am able to negotiate instalments. I have also been promised (for what thats worth) that the Statutory Demand wont be issued "as we are negotiating". Well I have send a massive complaint to the OFT and will see the CAB as soon as I can. All I can say boys and girls - DO NOT LET THEM WIN and continue operating the way they do. Consumers have rigths and they have to stick to it.
