I'm not sure if I have got this right. Have just got in from work and trying to catch up with posts. Are you being asked for £10 for proof that you owe a debt, or paperwork associated with it? . If so, tell them that any proof of debt has to be sent FREE OF CHARGE. The only thing they can charge you for is the SARN (Subject Access Rights Notice) which is a copy of all info held about you at the particular company, under the Data Protection Act (DPA) . The standard charge for this is £10 and has to be given within 40 days. Sounds like they are trying it on, or mixing up the two Please pm me if you would rather. Buzz wink |

I work for Citizens Advice Specialist Support Debt Team and have had a lot of dealings with Yes, Direct Auto Finance, Go Debt, Edwards Geldard and Hollis Briggs (part of EG), in particluar in respect of their attempts to make people bankrupt. We have put together an argument that relates to the PPI included on their agreements which is stated to be optional on the documentation. Many borrowers state that the PPI is not optional but in fact complusory. For example, some peolpe state that they were told that if they didn't take out the PPI they wouldn't get the credit and others state that all the insurance figures were completed before they were presented the agreements to sign. If the PPI is in fact complusory rather than optional as stated in the agreement, the argument is that this makes the agreement completely unenforceable under the Consumer Credit Act 1974. This hasn't yet been tested in court but as a result of putting this forward as grounds to have statutory demands set aside or bankruptcy petitions dismissed, a number of statutory demands and petitions have been withdrawn. We are waiting to see if the debts will be pursued after this has happened. If anyone has a problem with Yes and threats of bankruptcy, call in at your local CAB and ask them to call specialist support (debt) (NB this service is not available to members of the public) |

Dave, Have you approached the CAB? They should act on your behalf with regards to paying the debt. At least go and see them first. |

yea on sunday i was shouted at by a memeber of staff who kept implying i was lying and today i was told i was being silly by mr PAUL EVANS who also took great pains to make me aware he was an expert and that what he was saying is right cos its his job . Mr Rhodes please contact me by end of today |

oh and i meant to add that i was being silly because i offered to pay a 6107.30 debt with £150 a month ,the original payment was £210 for a 10 grand debt |

I cannot understand why they wouldn't accept that amount. If you could afford the £210 per month (as per the YCC agreement) chances are that you wouldn't have this debt in the first place. John |

they want all sorts of info payslips etc...... which i don`t have going back 3 months . I work down to cardiff regularly i`ve a good mind to go in and see these people in person and see then if they`re so arrogant . I`m also going to see a solicitor regarding their behaviour |

When you go to the CAB Monday ask them to call their support specialists. Refer them to YCC because these guys are questioning the agreement terms and they are finding flaws in it. I've had a look at another agencies report regarding the agreement and they have found a few flawses to the extent that any statutory demand could be easily set aside. That is it makes the agreement unenforcable. I'm no expert in this but it is really worth going down this line and seeking their expert advice. The above agency have requested witness statements from us so get your one over to admin@saynotoyes.co.uk. It will then be passed onto the agency. Good luck Monday and let us know what happens. |
