I think you know my story W but for you Buzz here we go. I brought my car from the Nottingham branch 16 October last year. This week I've treated it as a memorable service. A Megane W reg, 239 pounds per month of which 80 on insurance ( do not have the pound sign on PC's out here). I needed a car because of a new job and I needed it like now. Never again however the urgency. To be honest not many problems with the car, noisy brakes in the 1st week but they sorted that out. The exhaust fell of after 6 weeks so alarm bells rang. Got a friend who is a mech to check it out and he found no probs. So overall cannot really complain about the car. One thing I checked on was these insurances. I informed the salesman Adam Ostley that I wanted to finalise the deal in about 6 months. Was about to come into some money. He informed me that the insurances would not count in their sums. Either a lying bastard or did not know what he was talking about. I was not informed that it was 4 years worth or given any amount details. Should have known better but when you are told........ Saw the Whistblower programme when I was considering finalising the agreement. Then got my final settlement for 8500. Now this was war. Fortunatley got offered another job abroad at the same time so took time out to think. In that time got involved in the Yescarcreditsucks, met W in cyberspace and while abroad contacted Charlie MacDonald to terminating my contract. Complained how I felt conned and got the reply from him "I was not there". He requested I returned the car which I did when I came home on leave in June. I expected a letter from him but got the usual correspondence. So the score now is that Hollis Biggs are chasing me for 6500. I've left it with my solicitor and today I got an e-mail saying they are going for bankruptcy. The car side I know I owe and to stop the bankrupcy application will cost me 2000. This my solicitor hopes will be the final settlement. So if thats so then am happy and will put it down to experience. The insurances side he is confident will be dropped but I'll let you know. So summing up my story should be coming to an end. I'm lucky I can afford the whole 6500 but why should I pay. 2000 is what I expected. But and the big but is that I feel I was misled. That will stay with me for a long time so the battle is lost but the war is to be won. In my eyes that war is seeing the demise of YCC, wiping the smile of William Rhodes and anyone else associated with YCC. Thats my story. |

Baked., Fight the bastards all the way. Dont let them bully you. As far as I'm concerned, threatening bankruptcy is tantamount to demanding money with menaces. If a loan shark were to threaten you in any way, it would be against the law. Debt companies, however use similar distressing tactics, but seem to get away with it. My story is similar to yours: Had to go to YCC as member of my household ran up large credit card debts, hence me blacklisted. My car at the time was running on a life support machine and as I work silly shifts far from home, I neede something reliable. I opted for a Renault Laguna ( S reg), as out of all the cars in the showroom I was told only three fitted my payments! The other two were unsuitable. Realised straight away that I had dropped a bo**ock , but like you I needed a car now. I was told the insurances were compulsory. ( Cancelled them a week later). In a way I suppose if they had been honest, they could have sold me a dearer car for my payments, but with them including them in the initial deal, the insurances were a large portion of the repayments. Now instead of paying them £140 a month, they are only getting £91 a month, so in a way they did me a favour by trying to con me.. (does that make sense!) The ironic thing is that about a month later, I was offered another job ( like happened to you ) with a company car, so if I had waited, I wouldnt have got in with YCC. Mind you, I dont work there any more but that is a different story. ( wish there was a " say no to working for NTL "site!) Anyway, like you, I originally joined the "sucks" site until Mr. Mosely closed it down with his I'm alright Jack attitude. Then found this site, which is far superior and is committed to its members and not just one person. The rest is history !! aaa Seriously though Baked, Fight em all the way. Keep us posted. Buzz. Hi Buzz, You are working hard these days. Don't worry I intend fighting them. at the moment things are going the way I expected. I ended my agreement 15 months earlier so expected to pay for that. Its the insurances part I'm fighting against and by the looks of it they are going to be dropped. If they insist then I have my ammo ready. My job here is an open ended contract. That is its for 2 years but if I want to stay I can. At the moment it looks like they want me for the next 8 years so its looking good. Good money, good weather and good evwerything else except for no alcohol. Mind you some of the "home brew" is pretty good. When I come home for leave I end up drinking my mates under the table. At present I'm selling my home and setting my family up in another country. When I spoke to a solicitor friend of mine about YCC chasing me for the money he told me not to worry about paying them as I'm out of the UK jurisdiction. Well I cannot think that way so decided to fight them. Just the way I am. Mind you when my episode comes to an end I'm hoping my identity is still not known. Then I'm going to ask Rhodes how he feels that YCC sold him a debt knowing it was practically impossible to chase due to the debtor no longer being resident in the country. Lets see how he likes that. We are going to have to wait a little bit longer for that. wink |

Well don't these things go on and on and on. I'm back out here in the ME. You can see me on the map. The wife is back in the UK sorting things out. Hopefully she will joining me before Xmas. So while she is there she chase up things and this is how its gone:- Let me remind you I told Charlie MacDonald I no longer worked in the UK with no intentions working again. Good of him to sell the debt to Godebt especially as it would be impossible to summons me. Cannot wait to tell William that. Of course if he is still working for Godebt by then. Apparently in my absence they have sent someone around my house with a summons. No one there. Sent a letter to me asking if we could meet to discuss. Umm has no one told them I don't live there. A bit of investigation work would have discovered that. Anyway me being me when I found out about this from my friend who had my mail and I asked him to pass it on to my solicitor. As you know I've agreed 2000 but today I found out they want 5000. They have brought it down from 7000. We are disputing the insurances and my solicitor basically told my wife that they either take the 2000 or get nothing. They know what I expected, the insurances are unenforceable. Don't worry my solicitor told my wife and if they come to the house we will have them. I really hope they are stupid to do that. So there you go, hope you enjoyed the latest espisode. Cannot wait to drop MacDonald in it. |

Brilliant this map. Yes I'm Kuwait but I'm not there. I'm 70 miles South in the sand. I have satellite broadband and I've always wondered where my ISP was. South Carolina is an interesting one. Anyway can the device put a user name to a spot? I wonder who is the Cardiff user? It might not be WR as I know John I think lives around the corner from their offices. Like to know who the Long Eaton/Derby users are. Would have given them a visit when I was home. The Gloucster one is Whisperwolf. Oldham, is that you Buzz? |

An update to my case! Well there is no update. No one is talking to anyone. Ummmmmm. Mind you reading other cases on the site GoDebt do seem to stall alot. So this is what I'm thinking. As you know lately we have heard about Godebt withdrawing SD's because of these legal arguments. Apparently they claim that they do not agree with the arguments but have withdrawn because its not cost effective. What a load of B*****ks. Its most likely because the agreements are unenforceable and would loose in court. If that happens then the victim could claim back costs from GoDebt and that would definately be cost effective. Perhaps their right looking at it that way. So now I'll tell you what I'm thinking. I'm getting my solicitor to talk to the CAB, hopefully Chauntelle, to discuss my agreement and see if any of the legal arguments apply. If they do then I might take it to court and see if I can get mine unenforceable. That is nullify the debt. Can you imagine what a pull that would be. A saynotoyes mod outdoes WR. Of your there is a risk that I could loose then I'm sure GoDebt would claim costs against me. Thats the risk. I've got to consider if its worth the risk. At the moment I feel like taking the risk providing the arguments are there for me. I'll let you know. |

Update time. This time there is an update. GoDebt have agreed to my final settlement. After a bit of a consultation with my solicitor it was agreed that the car side of my agreement was binding so I at least owed that. The insurances side we were in dispute with as you know. As far as I was concerned I owed £2000 and thats what I offered as you all know from my first post. Well thats what they have accepted. So I'm no longer being chased, my case has come to an end. The way I look at it is that I've paid no more insurances since handing my car back and I perhaps have avoided the disappointment of my car breaking down only to find I'm not covered by any of the insurances. Fortunately I can afford this so I'm happy with the overall outcome but will reflect on how I fell for it all and the fact that Godebt have got some of my money. There is a good enough reason to carry on against these people. I have been wondering lately why they agreed finally to my offer. I have not budged from my first offer and they, Godebt, have come right down to me. Ummm, something to do with what has happed lately, legal arguments etc. Something tells me their the ones scared now, starting to run, perhaps their the ones now being bullied. Whatever I'm not going to let up and I'm carefully planning my next attack. I did mention I was going to tell WR I no longer live in the country and YCC passed a debt over to them that was practically difficult to chase. Perhaps they know that and took my offer, don't know. Whatever it was a dirty thing Charlie MacDonald did and I will pass this onto WR. Wonder what he will think of YCC and Macdonald now especially as YCC are out of business and their contracts are suspect. Well guys gone on a bit . I'm a happy user now my case is sorted but I intend being alot happier once we see more of our users winning their cases. Somehow I don't think we have much longer to wait to see these. upt |
