Godebt Strike Again|; DISCRIMINATING AGAINST SOLDIERS.

Hi,
This is my first visit to this site, and i would like to congratulate you on providing a very informative site, thankyou.

My story is very similar to those on your site, but with a slight difference (I think).

Mrs Oberay, from GODEBT phoned me today at work to chase up an outstanding fee of £1012 from when i voluntarily terminated a car agreement with YCC in Feb 05. - the first I knew of this was in August when someone out of the blue phoned me to say that this debt existed and it needed paying in full. At that point I offered installments (as we had just bought a house and money was tight) They would not accept this offer and told me that it would probably go to Court, but they would go and discuss it with YCC and come back to me. I heard nothing from them until today.

The woman from GODEBT was very rude in my eyes and also very insistent.

Firstly she said that this had been going on far too long and it had to be settled today, again I offered to pay in installments, again this was flatly refused.

Secondly, she suggested as a home owner that i should either remortgage or borrow the amount owed to pay this off, even if it was off a family member or a freind. I refused to do this saying "i was not going to borrow off peter to pay paul"
and "who would remortgage my home after me only owning it for less than 6 months". Again i offered installments, again flatly refused.

Thirdly, she suggested I borrow the amount from my employer or she would contact my Commanding Officer as i am in the Army. Again i offered installments.
This time I was told "We cannot accept installments because you are a property owner and a SOLDIER".

This stopped me in my tracks as I classed this as discrimination. My reaction was to actually point this out to her.

Fourthly, her reaction was to tell me that she would be contacting my CO and that a Bankrupcy Order would be served to me at my place of work with my CO present.

If this was trying to put the frighteners on me, it worked for twenty minutes. I logged onto your site.

I found your Legal Guidelines provided by OFT, (and after reading through them, i feel slightly less wound up) and have identified at least 5 points used by GODEBT that amount to unfair practice. I have also appointed a third party (Euro Debt) to act on my behalf in corresponding with this firm.

Mrs Oberay concluded our conversation by telling me to speak to my CO and getting him to phone her next week. She will call me on Tuesday next week.

This last part is not going to happen now that i have read Debt Collectors Visits.
I will phone her on Tuesday.

Now that I have had time to calm down and browse your site, I am after information so that I can put forward a complaint to OFT.

1. Is there any difference between a Soldier and a Civillian when it comes to paying debts off as I did'nt see any thing in the smallprint of the agreement.
2. Are there different guidelines concerning Soldiers when it comes to DebtCollectors.
3.Are Debt Collectors allowed to discriminate against certain catergories of workers. i.e Soldiers, Policemen, Nurses Secretaries etc.

I know these are silly Questions, but for my piece of mind, i need answers.

I am sure that both the OFT @ Trading Standards would be more than interested in listening to your issues. A contact for the OFT is displayed on this forum.

Clearly OFT guidlines are not being followed by GoDebt. (Again)

Going on your testimony these guys are totally out of order. This is what I recommend you do: -

1. Report Yes Car Credit/GoDebt to your Welfare Officer. Get your message across the whole services to avoid these companies.

2. Go to your local CAB. They will act on your behalf regarding the debt. Always good to get an authorised 3rd party involved. Ask them to call their support specialist teamwho will look into the agreement.

3. Send your story to admin@saynotoyes.co.uk. We will then send it to an agency who is challenging the legality of the agreement.

4. Get your story over to the OFT James MacDougall@oft.gsi.gov.uk. See our banner. Also get Trading Standards involved.

Do not worry about the bankrupcy threat. Report it but do not worry. The fact that you have put in an offer to pay by installment is enough. If and only if, which is unlikely, they take you to court then it will be down to the judge to make you bankrupt. This is the last course of action and basically only applies if you cannot pay the debt and the future looks like you will not be able to pay it. Then a bankruptcy order will be issued where the creditor can force you to sell your house/assets etc to fund the debt. It really is a last desperate order but as you have offered to pay by installments then the court would not make you bankrupt. If fact it would be silly for Godebt to take you to court as the judge would throw out their claim due to the fact you have offered to pay by installemt, providing you can prove you can afford to pay. This would incur costs to GoDebt.

Going on your testimony the behaviour of the agent alone is worthy of reporting Godebt to the OFT.

This is EXACTLY why I haven't bothered to make a formal complaint about my call.

"We do not have a Ms Oberay working for us"

Plausible deniability. You get a name but not record it, they say that no such named person works for them. You record it, they sack the person concerned, blame them for being 'one bad employee whos views are not representative of the company' and don't change their ways.

Fact is, though I was shouted at by a GoDebt employee during a call (and not for the first time, I might add!) they're doing a difficult job under difficult circumstances. I don't at the end of the day hold any one member of staff solely responsible, neither do I think it's worth getting someone sacked over.

The company POLICY in regards to how it behaves is what needs to change, and that's a management steered decision.

To answer your points in order:

1) Yes there is a difference between civillian and Armed Forces personnel and they were quite correct to state that they can get your CO involved. This is not part of the contract you signed with YCC but is a condition of your service. Your CO can deduct money directly from your salary if he/she thinks appropriate without Godebt having to take you to court - you need to be careful.

2) Well yes - based on comments above, same goes for the Police as well although their welfare officers deal with it differently these days.

3) No discrimination has taken place.

My advice here is to go to your Welfare Officer. There is nothing in the debt collection guide or your agreement where you should be treated differently because you are a soldier.
