At the moment hollis briggs are trying to make me bankrupt i am do in court this month and I am very worried about this can anyone tell me if they have actually got to court if so what has happend please help me. |

I am in a similar position as they are trying to make me bankrupt as well, I am sorry that it has come to that, as I know its not a nice thing |

Sarah welcome to saynotoyes smile It's imperitive that you make contact with Citizens Advice ASAP. Don't worry, they have a dept set up to deal with both Yes Car Credit and Geldards LLP (hollis briggs) Do not agree to anything with Hollis Brigss until you have made contact with the CAB They hold several legal aruguments that may see your finance agreement unenforceable. So, tomorrow get in touch with the CAB explain you have made conatct with our forum here and give them the full details. Keep in touch! |

i have been to cab today they have photocopied everything if they need more info they will contact me tomorrow if not they are going to look through everything and get back to me on monday iam really worried has if i go to court iam going to lose my property when i have two children to look after

Hi Sarah, Sorry to hear about the problems you are being caused by the threat of bankruptcy, It amazes me that Hollis Briggs, Godebt, Geldards ( or any other name they have changed to this week) still persist in trying to intimidate with the threat of bankruptcy. One of the selling points that YCC used to advertise was that the loan was secured ON THE CAR, not YOUR HOME / ASSETS. How then can they justify bankruptcy proceedings? YCC knew the risks of giving us the credit. The astronomical APR reflected this. What YCC (RIP) aaa now realise is that if they had thought more of the customer they would still be in the business of selling cars. Unfortunately for them , what goes around has come around. With all the bad publicity (and this site) people stopped going to them, resulting in massive losses. Dont be bullied by Mr. Rhodes. You have the support of all of us here on the forum. The downfall of YCC was just the starting point. Buzz. wink |

Mate, you are on the spot with that one. Every customer of Yes Car Credit was assured that there would never be an issue with the loss of their home or any other assets if the loan was not re-paid The loan was simply secured on the car. If you get into any difficulties with the payments, don't worry, all will happen is the car will get took off you. Your home will be safe, it's not a secured on it. 'Complete peace of mind' 'Loan secured on the car not your home' What Yes Car Credit failed to tell customers is that if you do have problems with the payments and we take the car back we will sell the debt to Godebt, they will then make you bankrupt with the possibilities of you losing your home Misrepresentation Act 1967 A misrepresentation is a false statement of fact made by a party or their agent, which is intended to and does induce the other party to enter into a contract. The party who has relied on the misrepresentation will have the remedy of rescinding the contract or in accordance with the Misrepresentation Act 1967 may be entitled to damages for non-fraudulent misrepresentation unless the representor can show he reasonably believed the representation to have been true. This is another reason why Direct Auto Finance contracts should be made unenforceable |

:blink:im so fed up with it all now i just want it sorting out it is starting to interfear with everything i dont want to be made bankrupt my children are even starting to pick up on it now i cant even see what hollis briggs will get out of making someone bankrupt because wont everything go to the official reciever they would be better off accepting monthly payments am i right |

As I said I am going through a similar problem, I have offered to make monthly payments (even though i don't feel I should) as I have not had the vehicle for nearly 2 years now but Hollis Briggs seem to ignore the fact that i am offering, I am completly fed up as it would be 3 years at the end of this year that I made the most stupist mistake of my life |

i have also offered monthly payments very high ones and hollis briggs dont seem to want to know untill i have sent a redemtion figure on my property did you have a stat demand before bankruptcy notice |

Harpet and Sarah. Can I suggest that you both contact BBC1 Watchdog and inform them of both your situations. This process from GODEBT, quite simply must come to an end. Why should Godebt be interested in your redemption figure of your house? is it a plan to take the house from you. No mention of that from Yes Cars when you were buying the car. ycc sent me a letter today,telling me i had 5days to give them over £4000,i phoned then and told them that my solicitor was handling things,and that anyway i had paid over the required ammount on the car before they had to have a court order,before they could take the car,they took the car anyway without a court order,and that is why i have a solicitor involved. there answer to me in an abrupt way was that i had to have paid 2/3rds of the amount before they had to get a court order,and that my solicitors if they were doing there job properly should of told me this. the solicitor did not need to tell me nothing as THERE agreement tells me what i should of paid before a court order had to be sought. i know ycc has ceased trading but there ghosts still live on. |
