were being chased for bankruptcy .

We went to yes car credit after receiving their invitation to come see their cars.. after all they would not sell us a car unless we met their criteria. Also we were entitled to a £250 cash back as we applied online. We were desperate for a car, as sam could not do her job without a reliable car. Her current vehicle was a worn out fiesta that her employer was loaning to her… he needed it back.

When we got there they took us into a small office with a desk, 3 chairs and a phone. The lady sales advisor sat with us for a long time finding out what they believed would be our budget according to their scoring system. They took us outside and showed us the only car they had which was a V reg. focus estate. Samantha didn’t like the look of it, as it was white and an estate. It wasn’t a diesel and it was a 1.8 that meant it would be a bit thirstier than she wanted sam does a LOT of miles... She wanted a large family hatchback like a vectra or mondeo diesel. .. They had none bar the top of the range ones, which were too expensive. The weather was terrible. It was raining heavily and trying to snow. They didn’t offer an umbrella or some kind of cover.

After what seemed like hours she took us into the little office again with a pack of papers and sat down. It was getting late now and we were ready to go home, but she was insistent that we should hear all about what their aftersales package was, and the car fault repair package etc. it sounded very interesting and the insurance package was a real selling point. We said we were interested but we were concerned about that fact that the car would be covering a lot of miles. 500-700 per week would be the norm. Would the vehicle cover apply still? She side-tracked a bit to say that no matter what the fault on the car; the technician would look into the best repair available… I asked again, as this wasn’t a definitive answer. She insisted that our mileage was not really an issue, as the policy would run for as long as the loan. Then they dropped the bombshell… the cover was not included in the £4999 tag for the car. In fact without the extra cover, the car had no warranty of any kind so if it failed… it would be up to us to fix it. Of course we needed the cover then.. Cars can be costly to fix! They said the cover was related to the cost of the car so if we bought an expensive car… the cover would be expensive. As the focus was the cheapest thing we could afford… the cost would be relative… though the exact figure was not disclosed. It would be calculated and added to the final figure.

We were getting a bit suspicious to the route that the sales pitch was going and we put our foot down and said that we were not prepared to spend the sort of money that we were looking at spending on this car… it wasn’t the car we wanted. The woman said she better go speak to her boss. She left the room and returned with a scrap of paper saying to reduce the car price by £250. We said we would consider it and would return tomorrow after having time to talk about it. She said to please wait while she went to get her boss. He returned and asked her to leave and he sat with us and had a scrap of paper with a few figures written on it. And went though the whole meeting we had with the saleswoman. Saying she met every criteria. She found an estate car, which was “better” than we were after, she got a £250 reduction in the car price. It was within our repayment budget etc etc … so we were in the wrong and we were wasting their time by going away and buying a cheaper car that would no doubt be a banger… after all… how could we afford to buy a car with no cash upfront? Our monthly budget would not afford a car and that we could drive away a focus estate TODAY!

Ok… we were beaten and decided that they were right and we needed a reliable car. It was now totally dark outside and raining heavily still. We didn’t get a test drive as the battery was flat and needed a quick charge. “Its quite common on a car forecourt for the battery to run flat”

We were given a pile of papers to fill out. But we could not have the car without leaving a deposit… it was our “commitment to the purchase. I refused to pay more than £50, as we were broke. They accepted it and asked us to sign the documents. Which we did. After filling them in we were a little concerned as the vehicle cover was extremely expensive… it was another 50% of the value of the car!! Stupid money… they did however assure us that we were still just inside the budget and should have no problems affording it… imagine if the car broke down? We said that we weren’t prepared to pay the money they wanted and that there were breakdown companies who would charge a lot less. We could NOT have the car unless we had their cover. As long as we were borrowing the money from yes car credit then we had to buy their cover. We were stuffed. We’d already signed the papers in any rate. We enquired about our £250 cashback. We were told we couldn’t have it as they had given it to us in the form of a discount on the price of the car… cheeky buggers!

We were about to leave but they informed us that our car insurance was not good enough for them. We had to use their approved insurer. This was a joke! We sat for half an hour sorting out another policy over the phone with the manager in the little office with us, guiding us through the call. After that they said we could have the car… after the quick boost charge the car started first time and we were on our way. The tank was empty so we filled up on the way home.
The brakes were very noisy so we called yes car credit on the way home who assured us the noise would quickly pass after a few thousand miles as the brakes hadn’t been used for a few weeks…. Ok.

The next morning we found a lot of oil under the car. Worrying. We opened the bonnet and found that the oil filler cap was missing and the underside of the bonnet and the rest of the engine was covered in thick black oil. The oil was too thick and black to be after a recent oil change so the car had not been serviced for months. They must have simply topped up the oil. Topped up the oil???? Was there a leak?
also the 12 months tax was not on the car... the current tax disk expired 3 months ago!!

We called the garage again and told them what we found. They said not to worry and apologised for leaving the cap off. We said we weren’t happy with the car but they insisted we keep it for at least a week. Which we did. we didnt get the 12 moths tax as the post officewas closed at the time of sale!! apparently we were given a discount on the price of the car instead..... WHERE??!!

After a week we said we still weren’t happy… but we had missed the cooling off period. We couldn’t hand the car back


The battery kept going flat over the weekends with no use but the battery was not covered. So we got a new one ourselves. The brakes were not getting any better but they too were not covered by the policy.

After a while the car developed an engine knocking, but we were told that we had done over the maximum mileage allowed and the policy was now void!!!!!!

They had lied about the conditions of the policy and had forced us to pay for the policy when we didn’t want it. they didnt tax the car.
they didnt include the 12 months aa cover.
the car wasnt serviced

they are chasing up bankruptcy proceedings for the sum of 13k.

not bad considering the car was 4990

I never received my £250 discount or my 12mnths car tax, there wasnt even a tax disc on it.
I did manage to use my own insurance, I was also told that I would be given £1400 part ex for my old car yet this somehow ended up at only £700 as they said they had to sell the car at auction and if the £1400 was made on the car I would receive my other £700, to date I have not heard anything about this.
The petrol tank was also empty and as I only lived around two miles from the showroom, though I would make it home.
No such luck, I was half way home and the car broke down in the middle of the road and I had no money on me, luckily for me a good samaritan helped me push it to the pavement and I used my mobile to call my partner who went and purchased a petrol can and petrol
.
Two months later, I got in the car to go to work and the clutch seemed to be very slack.
When I got back into the car at lunchtime, it wouldnt even go into gear and I had to call the RAC who came out to works carpark and informed me that the hydrolics had gone in the clutch.
I had to take a half day off work, get the car towed home to a local garage and was charged £148 for the repairs asI needed the car to get back into work the following day.
Apart from the clutch, the car has been sound.

The most ironic part about my purchase was the fact I had used YCC around 4yrs earlier (different branch), defaulted on the agreement due to the car falling apart and leaking very badly when it rained.
After returning the car I was originally left in around £11,000 eek censored debt so I decided that there was no way I was going to pay it and changed address and stayed on a low profile for a couple of years. They caught up with me due to my name being on the Directors Register as I had set up my own business. The debt was passed on the Thames Credit who contacted me, but the debt was now only £7,800.
I contacted them and asked if they would give me a settlement figure and they said £3500.
I informed them that I would try to raise this but it didnt happen and I made the first payment of £500.
When the next payment was due, it was Dec 04 and I needed cash for Christmas so I called them and told them that I would not be able to meet the payment offer I had made until March and told them I would only be able to pay £30 for the next four months wist (The operator nearly fell off her chair thinking she had mis-heard me)
I confirmed what I had said and it was agreed, £30 for the next 4 mnths.
They called me again if Jan asking if I had managed to get the funds together for the settlement and on my friends advice I told them that a friend said he would loan me the cash and pay it on his credit card but I would only be able to get £2000 as this was his credit limit.
I was then asked if I would be able to pay the remainder in a timely fashion and I informed them that if I paid the £2000 I would not be able to pay anymore cash as I would be paying my loan back to my friend and would not have any spare cash left.
She went away, spoke to her boss and it was agreed, I had a settlement of £2000.
So, in the end I managed to get an initial debt of £11,000 down to £2000 clap :P .
It was only 7mnths later when I went into my local showroom to see if I could get a car as I was desparate for a new motor for work as my other car was becoming dangerous to drive as I had run it into the ground, surprisingly, I seemed to pass with flying colours, didnt get duped onto their insurance or extras like cover etc.
So it just goes to show how many credit checks they do on you, all they are interested in is a deposit and the fact you are employed cos I don't know of any company who would give you credit after you default with them, let alone not pay them anything for over 3-4yrs.
They should have been called Naughty Car Credit!!

you've probably already quessed thats it's Go debt who is trying it on.

CAB says ours is a very strong case and is pretty clear cut.

the good news is that now we've seen the local CAB.. they showed their barrister a copy of our aggreement and our statement.... seems that we were right to send the car back and not pay any more.... as they are 99% convinced that it is an illegal contract and that we could in the best case scenario be getting every penny back that we've paid.. including the insurance.

forgot to mention that the drivers insurance that they insisted we took out in order to drive away the same day... was also sold illegally and the time on risk that they are trying to claw from us will probably be cancelled too.
fingers crossed!


cant believe that our local CAB office is goung to be closed this year due to lack of funding.. what a bloody great service they offer!
