bought a car for my fiancee from Yes Car Credit in 2001. When my fiancee and I split up, she left me the car and since i had my own car, I contacted ycc so that I can terminate the agreement and let them have their car back and this was in august 2003. I had paid back more than half the amount so i was entitled to return the car with no cost to pay. they dragged this situation until they defaulted the case and passed it on to Go Debt. I contacted the go debt advisers but all they were interested in was the out standing amount of £3500. I explained the situation that if I'm to pay anything it would be after the car has been repossessed and auctioned and then i was willing to negotiate the settlement of the difference. They say I could sell the car privately but since its on HP, i cannot do so and i cannot go back to ycc since they don't exist anymore. Is there anything i can do to have the car taken off the HP register os to return the car. help please |

Have a read of your terms and conditions. I am confident it will state that you are not able to sell the vehicle until all your repayments are made in full. After all it's Yes Car Credit who are the legal owners of the car. Good advice from Godebt?

James But you've got to think a little further ahead...... In the agreement it says that monies are owed to the original creditor. But not now - the debt was legally assigned. The relevant bit is the master agreement between the original creditor and either Go Debt or whoever bought the debt. Pause for thought. William Rhodes |

James You imply there there is a difference here - there isn't. The customer's rights are honoured - that's the law. Who they deal with and who they owe the money to is of no consequence to them - - rights to receive are assignable. Just stop and have a think please! William Rhodes |
