To cut a long story short... Just over a year ago both my wife and I went to Carcraft of Leeds, West Yorkshire to look at cars. We found

a car we liked, a Landrover Freelander. As clearly advertised we thought we would be driving away within an hour of finding the car we like.

This was not the case. We did in fact spend over six painful hours going through their system by which time both wife and my 3 year old

son just wanted out. There are three particular points I must point out that has brought me to take action :-

1. At the time we didn't realise and we were certainly not told that the £2000 cash back wasn't, as they stated cash in our pockets as one

of there current promotions but was in fact added to the total loan with an interest rate I dare not even mention. The fact that this cash back

was actually part of the loan was NEVER pointed out to us.

2. Whilst going though one of there processes in a small cubicle with a guy we had never met but was clearly part of the sales process

we purchased an NAC 3 year parts and labour warranty. At the point of sale of this warranty I stated to the sales guy that we no longer

wished to continue with the sale of this vehicle because the wording in the warranty handbook stated that the warranty would only cover

up to £750 of the cost of any one repair. I said to the sales guy, and I quote, "We can't buy this car because if the engine should blow, £750

would never cover the cost of the repair." The sales guy said, and I quote "The £750 is per part claimed for and not the whole repair. Should your

engine blow you are still fully covered up to the cost of the vehicle purchase price. I.E. The warranty would pay up to £750 per part of the repair

that was required. £750 for new pistons, £750 for new head gasket, £750 for labour and so on". On the strength of this we bought the car.

8 months down the road the engine in our fully serviced Freelander blew. At the time I wasn't to concerned as I though I would be covered so

I had the car towed to Guy salmon Landrover in Wakefield. Later that afternoon they informed me that NAC would only pay the first £750 of

the £2500 cost to repair the car. I contacted NAC who stated that I was miss-informed of the NAC cover and that the terms and conditions

state that they would only cover the first £750 of the cost. I wrote to Carcraft of Leeds and as you can guess, because we were in a room

secluded from everything else and at least 4 hours into the experience it was our word against the sales guy who sold us the warranty.

After this I had read that this is an inherent issue with the K series engine in the 1.8 Freelanders and many consumers have had similar

experiences as my own. I am also in the process of taking this up with Landrover customer care and not getting very far with it.

I had also discovered that once the engine had blown it could go again at any time in the near or far future so I part exchanged the vehicle the

following week at a massive lost.

I paid £10,000 from Carcraft

Repair cost was £2500 which I had no choice but to put on my credit card

I sold the car for trade price at £4,500

I now know that the car was massively overpriced in the first place.

3. When we bought the car we had to get it serviced to uphold the terms of the warranty so after the first week of owning it we booked

it in to Landrover for a full service. Landrover informed us that the car would not go through an MOT in the state it was in and was not actually road worthy

without having £460 worth of work done. The warranty covered this with no real problems apart from the fact that I had to pay for it out

of my own pocket and then hope that NAC would cover the costs which they did. But my point here is that Carcraft had, and maybe still

have, a policy that they perform a 120 point inspection of every vehicle before it leaves the showroom. This was either not done or it was

not done correctly.

My whole experience with Carcraft had left me feeling bitter before we had any issues with our purchase. After the engine had blow and

we had pleaded with them to take our complaint with some seriousness and consideration they basically told us that the car was in good

order when it was sold to us and it was now nothing to do with them.

Surly, if you pay £10,000 for a car, it should last for more than 8 months. This car had a major fault after 8 Months and Carcraft were not

willing to take any responsibility for it whatsoever.

Please please help me if you can. I am going out of my mind with this. It's not even about the money anymore, although last Christmas

was cancelled in my house, it's more about me feeling like I've been the victim of a scam and now their just sherking any responsibility.

This is probably my last call as I can't go on with this much longer. It's eating into my life too much now.

There are two things that come to mind after reading your story. The condition of your car when you brought it and the validity of your HP agreement with Carcraft.

We have had a number of users who found themselves in the same position as yourself. They ended up going to Trading Standards to see hwere they stood and were informed that they could have a good case against the car distributor under the Sales for Goods Act. In their cases it was against YCC but in your case its against Carcraft. If you have kept all the paperwork of the repairs of your car then go to your local trading standards or even the CAB and see what they recommend. It might be a long battle but it could be worth it.

I know of cases where some agencies have challenged the validity of the HP agreement from Carcraft. Once against go to your local CAB and get some advice on this. If the agreement is unenforcable then you might just be able to hand your car back. You also might be able to recoop all your money, you never know.

I think a visit to your CAB or Trading Standards in a must. Good luck and let us know how you get on.
