I was recently contacted by Go Debt via letter where they requested payment of a loan from 'TMV finance' that was taken out under the name of Genesis Technologies. I was previously a director of Genisis Technologies. I legally dissloved the company on 16/9/2003. The company never had any employees other than myself. It never carried any debt or had any financing of any description. Obviously I have the financial records to back this up. Basically, I have absolutely no knowledge of this debt they are claiming the company still owes. I have never heard of TMV Finance, much less taken out finance with them. If a loan was taken out under the name of Genesis Technologies, it was done so FRAUDULANTLY AFTER THE COMPANY WAS DISSOLVED. My personal details, the company address, or company bank accounts (closed when the company was dissloved) were NEVER used. I am 100% certain that I am not legally responsible for this debt. Common sense tells you that you cannot hold someone responible for a debt on a legally non-existent company that they know nothing about. Its either a case of mistaken identity or fraud. EIther way, its not my responsibility. Both the CAB and my solicitor have confirmed this for me. My question is this, How can I get GoDebt to communicate with me in a constructive, civilised manner that will prevent us both wasting time ? I tried to phone but the woman I spoke to had absolutely no interest in listening to what I had to say, constantly interrupting me and generally been very aggressive and unpleasent. In her defense, I guess the company must get many people trying to claim they are not responsible for some debt or another. I want to try and resolve this before it involves solicitors and court appearences. I am 110% sure I would win in court but I just don't want the hassle and expense. If William Rhodes is reading this, could I call you and discuss the matter to see what we can do to resolve it without wasting time and money in court ?? Thanks in advance, Matt |
