Hi there I have taken advice from allhere and CAB, I called Red Castle debt recovery and requested a full breakdown of the debt that i owed them, they said they did not have to this. So i asked how much the car was sold for and they said they didnt have to tell me. So how can they justify their collection without any of this info. I then went on to tell them that i was Mis sold the insurance as i was informed that i would not get the car unless i took the insurance. They have obviously heard this before because they straight away jumped on me saying i never had to sign and could have walked away. When i tried to argue this they just said they weren't interested and hung up. I have been told that if you return the good that you are only liable for half the sale price so with my reconing the amount i owe nothing because of the amount i have already paid. Any advice please |

Ok, so I've absent-mindedly lost (again) the original posts I made about my dealings with YCC/DAF/whoever they are these days. Thankfully I'm able to keep track of the many letters I send to these bl--dy people or I'd be screwed. A little update for you all, although the fact that I'm posting this under a "Red Castle" posting probably gives the game away a little. The gist, again: DAF demanding incorrect amount. 3 letters sent to DAF to rectify error. 3 letters seemingly ignored (all delivered according to Royal Mail) Nothing for ages. Letter from... Red Castle Recoveries! Take a guess - yep, you're right! - still the wrong amount. You can't have it all ways, can you. Anyway, I wound up the entire situation including facts and figures about what was going on into a fairly concise (3 page) letter to Red Castle. Would you believe, they have these things called actual people who can read and digest the information in a letter. Extraordinary. They've "put my account on hold" while they query it with DAF. I'm guessing they have a slightly easier path to DAF. Quick summary for all you crazy people out there: Demand for: ~£1,500 Actual amount owed: ~£1,200 Discount offered from DAF for quick payment: ~£250 The way I see it, I was cheated out of DAF's discount because they all seem to be complete clowns... illiterate clowns. Actual amount, less cheated discount: ~£950. Offer amount to RCC: £500.00. We'll see what happens. If I can get it to go away for a much lower number like £500 then I'll be pretty pleased. I'm hopeful because I've offered them the sum in a single payment. When it comes down to it, I can't really be bothered fighting it but I'll be pretty reluctant to pay more than £500 for something I... a) didn't want in the first place; and b) am no longer receiving services from (payment protection). Oh, and "Plan B" / "Operation get-the-f-ck-out-of-here" is in full swing -- all packed and ready to move. *cough*. Naturally I've kept a copy of the letters I've been sending. |

Remember that Redcastle are based in Worthing, where Credit Acceptance was based, and a lot of the staff have flitted between CAC, DAF/YES and Redcastle or a combination. Guess who set up CAC in the UK - The same rogues who set up DAF!!! Same staff, same collection practices, same

Eddcole, It might be worth sending them a SARN. although this will cost you £10 they will be obliged by law to send you all associated documents regarding your details. If they dont reply within 40 days with the requested information then they have committed an offence then there is a chance they will have to write the debt off. From the lack of communication this might be worth a go. Amend our template for your use http://z11.invisionfree.com/saynotoyes/ind...?showtopic=1684 |

Ok...get that SARN of to them. They will not be able to do anything until they have responded to your request. That includes demanding a solution etc. Remember they have 40 days to comply. If they dont you need to report them to the Commission of Information. We will sort this out if this happens. Just keep in mind, they cannot chase until they have responded with the information. |
