have just spoke to someone at credit and asset recovery solutions,they either want payment or car back-i`m prepared to do neither,they`ve advised me to contact a solicitor,the person i spoke to was a mr bonnyface on 0870 6061210.he said that he knows more about the contract than cab do-i`m a bit worried about this,is this true? do i need a solicitor? i explained that due to the deposit being taken off the insurances and not the car(what i believed the deposit was for)then the contract was unenforceable-he told me that they always do this-where do i stand now? moors are involved re my ppi and hope to see cab on monday-please can someone advise me where i stand :(

For a start Credit and Asset Recovery aren't even a proper debt collection agency. What they are is part of DAF. The number you have rung has just put you through to a different part of the Head Office at Horsham. That is why he will say that there is nothing wrong with your agreement because he is one of them!!! Technically as well this business about the deposit being taken off the insurances isn't really the problem here. The problem lies solely with how the PPI has been worked out and where it is on the agreement.

If you are in contact with Moor Advice, the best thing to do would be to tell them of these developments as whilst they are launching a case against DAF on your behalf you shouldn't be hearing anything else about your contract. I would also write a letter to Mr Bonnyface of Credit and Asset Recovery Solutions c/o the DAF address at Horsham and make him aware of the fact that Moor Advice are now dealing with your case and that he is to correspond with them in future. Make sure you send the letter RECORDED DELIVERY though so DAF can't make out they never got it.

the person i spoke to also said that i had had a notice sent to me-i never recieved it and when i mentioned had it been sent recorded delivery he said that doesn`t matter and that it had been sent-but what proof do they have of sending it? what proof have they got that i recieved it? in a nutshell as far as i`m aware NONE! its correct what jenni says-they are part of daf and so now i`m going to see a solicitor asap and cab on monday.

Well if this Mr Bonnyface is saying this then it is no wonder YCC went out of business. So is this guy a solicitor, would he like to challenge the CAB. Why not put that to him.

Regarding the agreement being unenforceable I think we have enough users on this site who will vouch that their contracts have been set aside. When you talk to this Bonnyface again ask him to visit this site and see if he would like to input into it.

this boonyface guy isn`t a solicitor-i did ask him and and he says he knows more about the legalities of the contract than cab do-typical excretion from a bull!!!! :lol:
