Is this a new company being used by DAF/YCC or have one of the usual ones changed their name. I am due in court on 2/11 2006 because they want to put a charge of £7325 on my house. |

Hi and thanks for the welcome. All I am going to do is turn up in court and argue my case. A representative from Golds rang me yesterday and asked what I intended to do about the debt so I told him I had got some valuable information from a website called "saynotoyes". They must have heard of this site because the phone went dead lol. I know that YCC had some flyers that said that the debt is secured on the car not the house but I can't find it anywhere. If anyone out there has a copy of this leaflet can they let me know. Many Thanks |

Cheers that would be most helpfull. I sent all my paperwork to a debt management company in the hopes of getting an IVA. Just after that the CAB advised me not to go that route. Shoulda gone there 1st I know. Anyway they still have the paperwork so have to try another way. I am having to remortgage just in case they win. They are charging me £1.60 a day interest which dosn't sound a lot but I have 14 years left on my mortgage. I know I owe them some money but not that much. I certainly did NOT take out a secured loan. They want to make it a secured loan and that's what I object to. Anyway rant over. |

Hi a bit confused by the posting, if they have a CCJ againsy you, (which they must before they can go for a charge) then as its a regulated debt there should be no intrest? and a charging order in this case should not attract intrest? :wacko: |

Also at the CCJ stage did you make an offer and did the creditor/courts accept, and if they did have you been keeping up with the payments? becaiuse if you have an instalment order that you havent defaulted on then there is a legal argument against the charge. :wacko: |

My payments were £219 p.m. Then my wife's hours at work were drastictly reduced. I asked them for voluntary repossesion of the car, which they agreed to, but I asked them to let me know how much they got for the car and how much I still owed. They never sent those details. I got a letter from Golds solicitors saying they were taking me to court. I asked them how I could pay them and they told me I could pay £230 p.m.
I told Golds that I was still waiting for the final figure and they said they would forward me a copy of my account. The day after I got that I got a letter with my court date on it. Because the debt is over £5000 they can charge me a standard 8% interest.

Thats what I thought. All the interest is added upfront so any shortfall will include interest. So adding interest on the interest, interesting. :wacko: |

This is what I have found: - "Statutory interest is applicable to non CC debts and is payable at a rate of 8% for amounts over £5000. Such debts could be the refund of penalty charges etc." From what Garzy has said about Golds and from other sources I feel that YCC/DAF could be looking for other legal representation. Expect a "stay" of proceedings everyone, that is YCC asking for more time while they find someone else. Saying that though they could still stick with Golds. I say this because Golds are most likely hoping they win most of their cases by default. That is a victim of YCC not fighting but just paying up. My fear here is that I think we have only reach a fraction of the victims out there. So Golds will accept the lose of a few, those that have taken our advice, to what they will win of the majority, those that they will scare and pay up without seeking advice. The fact that they put the phone down on Garzy proves that. Lets hope the campaign reaches that majority. With the pending action of Stephensons I'm sure that is going to help the campaign. |

All Mods, I am sure 1 of you posted a link to a YCC website which showed that the loan was secured on your car not property, maybe 1 of you remember it. The comment you made was "I wonder how long before they close this site" Think the topic was on GoDebt sending round David Bailey....might jog some memories !! |

Lee, I believe YCC instructed all sites to removed references that refered to there claims that the loan was secured on the car and not your home. There is a link that Baked has just posted. Is this of any use? I am still searching! |
