Thank goodness for this site i tell you!! Xx Our story... My husband and i purchased a car back in June 2004 in scotland, for £4450. The car was in good condition, thankfully, and even traded in our own old car as part deposit. Though we did not get as much cash back as wed expect for our old car Our problems really started when i fell ill, and ceased working, which hit our finances considerably. We proceeded on voluntary surrender, due to these hardships, and the car was handed back some six moths later Dec 2004. During this time we tried to maintain payments,For the full amount, occassionaly, these were for half the amount payable. Our really problems started in July 2005, harrassment calls and letters, from Red castle recoveries. Despite numerous mailings from myself to them RCR and YCC, requesting full breakdown under the CCa,Also informing that we would not pay installments otherwise. We failed to recieve the requested breakdown. Finally in November 2006, after another call from RCR we recieved a print out, now from direct auto financial, though not as detailed as we'd like, it shows our balance as standing as £8715.36, Minus payments we made, Voluntary £1905.00write off capital £1246.68 balance £4747.40 then write off amount £4747.40 Balance £0.00 At the top of the letter it also has details as follows Account balance £ 0.00 And Arrears £0.00. Hope that in a court of law this would be helpful, in dismissing our claim. We shortly received another call form RCC recoveries, regarding payment? I explained regarding the above details, His reply was that he had also a copy of the letter and that the balance was still standing at £4747.40.lol It now appears that having had no joy through them we are now dealing with Resolution legal services, recieved our firt mail from them 19th dec requesting that the balance be settled by the 25/12.06.....another laugh there. After recieving this threatening letter of intended court action, we proceeded to, seek advice via CAB on the 21st dec, and also legal advise via them also. Since then i have since recieved two more letters, highlighting notice of intension for court action, via attatchment of earnings order/warrent of execution. I have next week a meeting with Trading Standards, in order to get some ground covered. I have been fortunate to have all letters/mailing form YCC?rcc and as well as our own letters we have sent also to back up our complaint. Having looked in more detail at he agreement it appears that DAF, are pursuing for the amount broken down as 50% car £2561.31 Insurance£2186.09. £4747.40 We also were unaware that we should have been covered for up to year, of my illness through PPI. Ts might be helpfull there also. We got stung for all insurance/being compulsary, through agreement, PPI MBC GAP No tax disk. We reside in Scotland, and would be grateful for any responses, regarding, this terrible situation/companys involved. We would also appreciate any afadavids/statments(scotland) from others in similar, situation as ours, especially if court action proceeds! Lesley aka Esy10, welcome to our forum. To me it looks like you have been going about this the right way. The only thing I would like to touch on are that there are a number of legal arguments against the YCC contract. These arguments have caused the likes of Resolutions to "set aside" the debts. You need to get proper legal representation for this. The CAB are the guys you need to talk to. ask them to speak to one of their specialist advisors regarding YCC. Hopefully they should be able to point you in the right direction. Any problems you know where we are. |
