Posts: 10 Group: Members Member #545 Joined: September 5, 2006	today recieved yet another phonecall from Europa Credito which is now dealing with the recovery of my apparent debt (mm for a car that blew up and i dont have anymore) i gave up today and said "fine just take me to court" they made an appointment to serve a summons on me for bankruptcy. hahaha what a joke seeing as bankruptcy can only be applied for if " the debtor has no means to repay or no resonable prospect of being able to repay" seeing as i work fulltime in a good job and now have my own part time business, i dont think that will happen, my solicitor is ready to get the whole thing dismissed under the sale of goods act. will kepp you updated hopefully with a win for me and then you can all use the judgment as reference for your own claims against them.

So you have gone from those nice people at KMI to this Europa Credito who sound like they should be selling Italian ice cream. From your previous posts it looks like your best bet will be the Sales of Goods Act. Another bankruptcy fan company hey. Just when we though we had seen the last of them.

Posts: 10 Group: Members Member #545 Joined: September 5, 2006	quick follow up_ since my last post the day of the summons serving came and went, guess what? No summons. i did phone them and say come on where is it then. They rebooked a day as apparently the server was busy and couldnt get to me on that day. So i waited for the next appointed day and go on guess? No summons, phoned them again and they said the summons server couldnt make it as they were too busy serving summons on other people who wont pay.... mmmm i thought, i live out in the sticks and the only towns near me are quite small so it wouldnt be hard to find out who would deal with this so a few phonecalls later and i found the only company where i live who would deal with it and , yes you know the answer, they have never heard of them. so unless the summons server is coming from Glasgow, 2 hours drive away, then i think someone is telling porkpies. As for someone coming from glasgow, i would think they would look at the address where i live and just say i am not driving all the way up there. I will keep you upto date and let you all know if they try again.
