Hi

I bought a car from YCC back in 2004. From the moment we bought it we had nothing but trouble. The drive shaft needed replaced which cost over £600 and apparently this wasnt covered by the warranty because it wasnt mechanical. I had the usual insurance scam but my trouble started once the wife was made redundent and couldnt afford the repayments. I contacted YCC explanied my situation and asked to give the car back. I was told i would have to pay at least 3621.12 and then pay 71.84 a month for the remainder of the contract (pay nearly £100 a month for somthing i didnt even have). As i wasnt prepared to do this i asked for a payment review. I got that review and the payments instead of going down started going up by about £20 a month, apparently if you cant afford repayments its good business to put the price up. Anyway it got to a point when i couldnt afford the car. The car ended up being repossed by 3 rather large blokes without ID or any form of paper work. Never having had anything repossed before i didnt now what to ask for or get. I have still not recived any sort of correspondence form DAF to say what they did with the car. In fact all i got was a court order for £6500. To make things worse i approched the court to dispute the claim and while i was in the process of getting varios forms filled out and sent back to the court DAF contacted my work (i am in the armed forces and nearly lost my job) and now have to pay £200 a month out of my wages, which i cant afford.

Any one got any advice as i like everyone else was told if i didnt take the insurance out couldnt have the car. The goods where faulty althougth i cant prove this as i no longer have them and i bought a car for £4000 paid back over £3500 and still owe £6500 even though they have had it back you do the maths B# censored#d

Chris, welcome to our forum.

First of all how many months instalments did you pay? To repossess your car they would need a court order if you have paid over a 1/3rd for the car (excluding insurance payments).

When they collected the car did you sign any paperwork.?

You mention court. Have you had any judgement against you regarding this? You say you are having to pay back via your work being military.

Now you brought the car when alot of the YCC contracts were "wrongly executed". That is they were wrongly written and most likely are unenforcable. There are a number of legal arguments against the YCC contract and most of them are agianst the insurances. As you have taken out insurance there is a high chance your agreement is unenforceable.

Onee thing you need to do is get this checked out. If you go to your local CAB and ask them to contact thier specialist advisors regarding YCC they should be able to tell you if you have a case or not.

The problem being in the military is that the welfare officiers tend to side on the 3rd party on matter like this and not on the guys they are meant to represent. Its a way of being in control of you. What they dont like is that they are bound by law and if you have a case where you have been unfairly treated then they could be in trouble. So lets see if you have a case or not, sort out DAF if you have then its up to you if you want to turn to your welfare man.
