Hi there. Read about your site and i am in desperate need of advice and help. I am about to be made bankrupt i think. Not sure if there is anything i can do about it. I was told that ppi was compulsory to be able to get a car. I gave them a £3000 car for a £4500 car. I now owe the best part of £6000! Mainly ppi. They refused payments from the word go and want the full balance. I just can't raise the money. They say they are pursuing bankruptcy and i have received a stat demand. Can you tell me if i can stop this? |

J, So its Godebt who are threatening you with bankruptcy. Thats tells me one thing. The contract you signed with YCC is most likely unenforceable. That is its not worth the paper it is written on. Let me elaborate. Godebt brought alot of debt from YCC. Then they stopped buying debt from YCC. Why, because some of the YCC victims who were in the same shoes as you now sorted legal advice via the CAB or solicitors. These victims managed to get their bankruptcy threats "set aside". That is basically written off. How did they do this. Well all over this forum we go on about some legal arguments against the YCC contract. These arguments were used against the YCC contract that Godebt are now threatening you with bankruptcy. When these arguments came to light Godebts MD stopped buying YCC debt, funny coincident that hey. Godebt have managed to make some YCC victims bankrupt though. This is because these victims neither defended themselves at court so Godebt won by default or they did defend themselves but did not know about these arguments. Shame but thats how Godebt win their cases hoping people dont turn up or dont seek legal advice. In fact I would just like to add that Godebt should not be issuing SD's against YCC victims. You only issue such things if you are absolutely certain the debt is owed. In YCC victims case the contract should be sound proof. Well we know and Godebt know its not sound proof hence why they "set aside" bankruptcy threats. So going on all of this you should seek that legal advice. In your situation J I would give Stephensons a call. See our banner for details. They should be able to stop this for you. Anoither avenue is your local CAB. They have had a number of successes against Godebt and are just as capable as anyone. So you know what to do now. Let us know how you get on. |
