hello and GREAT SITE!!!

I Bought a ca in 2003 for 9995 from Welcome. I have paid monthly payments of approx 9000k I would like to hand the car back but they say because of arrears to the value of 3000k approx I can't? My agreement states that I only had to pay 7500k and could hand back the goods. I am curently disputing this with them plus the 1000k in FEES that I have only just found (2 statements in 3 years, both at my request)

I am prepared to go to court over this...do you think I have a case?

where do the £3000 in arrears come from?

what is the total amount you owe them for the whole 4 years of the agreement?

Hi Jenni

I am paying them now and have been for at least 10 months. I have written to them to ask that it be put into dispute until it can be resolved.

The original arrears came from a period of redundancy. unfortunately I didn't have protection.

The entire agreement comes to 15k.

There is no mention on the original contract regarding voiding the ability to hand the car back...I understand it to be a right under the consumer credit act regardless if you have arrears....providing you have paid at least half of the agreement?

you have a right under section 99 of the Consumer Credit Act 1974 to terminate your agreement at anytime. If you do this before the half way stage you are liable for all payments up to half way and any arrears.

if you are over the 50% mark all you are liable for is arrears and insurances which you do not have. There should be a rebate though as you are terminating early.

Just remember to write a letter to them and send it recorded delivery and to keep a copy for your records and keep paying them until they say otherwise.

yes unfortunately you will have to but maybe because you have paid over the 1/2 way mark they may use this money to clear your arrears. Its worth asking
