Hi all, My story was not a happy ending. I took out a Loan from HFC 4 years ago for £5000. To cut along story short I fell into arrears and needed help with a Debt Managment Company. I reduced my payments and continued to pay the loan off as normal. Back in September 2006 I lost my job and fell behind with paying the Debt Management Company and HFC took me to court demanding that I pay the loan and all the interest at a cost of £12235 I disputed the amount and had to attend court. Judgment was entered against me to pay the loan and I agreed to pay the £5000. A month later I was back in court again to see if I had to pay the remaining charges, to my surprise after receiving a letter from HFC's Solicitors stating that I did not stand a chance in supporting my dispute they did not attend and the Judge struck it out. I rang the solicitors after to discuss the Payment of the £5000 and they agreed a repayment after supposidly going back to HFC to confirm the amount. I recieved my letter of confirmation to repayments and they then said they were awaiting the Courts desision on the remaining balance. This was after the second time in court and it was struck out. I am worried that they will try again and I will have to keep taking time of to attend court. Could I counter claim if they pursue this again and sue for harassment? |

Hi Folks, Well what can I say, I have now attended court three times over the remaining balance of my loan. The 1st time I had jugment entered against me for the 5000 in which I agreed to pay in monthly instalments, the second time the claiment didnt attend court and it was struck out, and just the monday gone I attended court and took in my original contract, the Judge to alook and after reading it for a while and cross checking with the claiments paperwork, he dismissed judgment against me as he felt the contract was unfair and charges did not add up. I am now awaiting the fastrack court and am very worried about the oval outcome. Will keep ya upto date with what happens Karl |
