I'm just going through everything to minimize any issues I may have with handing the car back. The car is due it's MOT not long before it's due to go back. Do I get it MOT'd or shall I leave it? Also, TAX is due to at the end of March. Do I pay for the TAX and let them have it or can I rightly take the tax off regardless of whether they are picking it up or not? Regards |

When you return your car you are NOT obliged to have it tax and MOTd. Saying that we dont recommend you drive it without MOT. Until you actually hand the car over you are responsible for it. Regarding the road tax you can actually claim that back via your local post office. Just make sure when you hand the car over you take the disc. |

Well it all depends on when YCC come to collect the car. If they respond and wish to collect the car before my TAX/MOT expire then i'm fine
:D At a push I will declare it off road, thus not requiring me to TAX or MOT it. Then it can be upto YCC to pick it up. How would the person transport the car legally if it does not have TAX or MOT? Would I be legally required to declare that it is off road and that they need a flat bed to transport it? Regards |

you would have to get a SORN to declare it off road. then you would have to tell YCC this is what it has. they will probably try to charge you to take the car away but DO NOT pay. it is their problem that they closed their business and it doesn't say anywhere in your agreement that you have to pay to have it taken back |

I can't agree with the posts here about Tax & MOT - take a look at 3.3 and 6.5 of your agreement - that is what DAFs would rely on when picking up a VT'd vehicle, and it's pretty clear what they expect. Good luck, HWYS. |

It doesn't state that it should have tax or mot at the point of hand over. Although it does state that the car should be taxed and all fines etc paid. As far as I am concerned I shouldn't have to hand the car back with tax as they never supplied the car with tax. |

I'm sorry, but it's quite explicit about the MOT - tax is not dealt with clearly, but a reasonable interpretation would be that the tax was paid up to date, and could be reclaimed by the person VT'ing the vehicle - 3.3 specifically denies the option to SORN the vehicle. Again, good luck. HWYS. |

It does state in 6.6 that the car should be returned with a MOT Certificate if applicible at your own expense. Whether that means I have to return it with a valid MOT or not i'm not sure. As for the TAX, does this mean I should be refunded this when I hand it back as by YCC standards they will say it never came with any. |

My interpretation is this regarding tax - as long as you have complied with 3.3 "You will pay promptly all road fund licence, fines...." then what happens at the point of collection is irrelevant, and I would suggest that you reclaim any outstanding tax by the normal route, as long as there is more than on month to claim, obviously. There is certainly no requirement to hand over any remaining tax value, as long as 3.3 has been complied with. I suspect that non compliance (with 3.3) would trigger a whole bunch of claims. Whoever comes along to collect your car I am sure will turn up armed with a set of trade plates. This will ensure that they are legal to drive a car without road tax. From a personal point of view I would not be handing over any road tax for the benefit of YCC, take it off and claim it back!!! |

Yes I would agree, if it states in the t@c's that the car must be Mot'd if the agreement is terminated. I think the road tax is a different matter though. |

My point is this - any deviation from contract terms will be seized upon by these people to bring down all kinds of charges at termination. Compliance with the contract is easy and straightforward to acheive, and ensures that DAFs then have to keep their part of the deal. My experience has been that compliance brings results, in terms of settling these issues (not very surprising really ?). Regards, HWYS. |

when I returned mine I had to have it mot'd to comply... it failed and cost me 260 quid to put right grrrr as for tax when you hand the car over or they collect it just remove the tax disc and send it back for refund as the tax is yours while you own the vehicle, after that its upto them or the next owner |

I agree with Highwaystar, I stand corrected regarding MOT. Comply with the contract, play safe and get it MOTed. Just make sure you keep the tax disc. |
