hi..sidewinder586 here and what a fantastic site you have here. i entered into my 2nd venture with YCC back in sept 04. now we are 30 months into a 48 month contract and i want to VT the car. i rang them this morning to ask what i should do and have used the sites template for VT...they also told me about terms and conditions and £80 for a pickup fee. i also took out PPI and GAP even though i'm self employed as it was a case of no insurance= no car!!!!. i called the solicitors mentioned but having been told i dont qualify for legal aid..it is just too expensive considering what i will try and claim for. my question to start is...do i cancel my direct debit for £217 after i send the VT or not |

there and welcome to the site.ok first things first - you say you are self employed. were you self-employed at the time you took out the PPI and which level of cover do you have? I ask this because some of them will not have covered you if you were self-employed and tried to claim. therefore, if this is the case and you were self-employed at the time and can prove this I would ask DAF for the money back you have paid into the PPI and if they won't do this then tell them you do not want to keep paying for it for the next 18months. whatever you do - DO NOT STOP PAYING THEM!!!! this will just cause even more problems in the long run. the other thing you have to think about is that if you do VT the car now, you will be due a rebate on the insurances outstanding. then you can pay this in one lump sum or carry on paying monthly as long as you are not or have not been in arrears. the thing about the £80 collection fee - ok you could ask DAF who will be auctioning the vehicle and contact the auctioneers yourself to see if they will charge for collection. the other thing to do is to contact trading standards and see where you stand on this as it is not your fault that YCC closed all its branches. however, if the auction house is relatively close to you then you can take it there yourself. also may I say - PLEASE REMEMBER TO PHOTOGRAPH YOUR CAR INSIDE AND OUT BEFORE HANDING IT OVER. we have had a lot of people on here recently who have had assessors out who have said the car is fine, the car has been taken and then they are receiving bills from DAF for £1000 for damage caused to the car. with photos if they try this then you will have grounds to dispute any claims they try and make. hope this helps you. good luck and keep us informed of how it goes |

update- ...they will accept the VT if i give them £80 to take it to Leeds (the auction place) and they want Half the insurance (i got 50% off) which is approx £588 and the whole affair will be completed. i complained about A) the £80...it didnt state anywhere i would have to pay and B) the fact i am self employed for the last 7 years. i was told to put it all in writing and they will see what arrangement can be done...so i will be doing just that. any ideas how i should word my letter? |

OK...... Sidewinder, my first concern here is that they have not put this in writing to you. So you need to start your letter something like this: - "Dear Mr YCC, Following on from our telephone conversation (date). Re: Account Number (Car Make/Model and Registration Number) I am writing to notify you that I am exercising my right to terminate the above Agreement under Section 99 of the Consumer Credit Act 1974. The car will be available for collection on the (Date) at the above address. According to my contract I am not liable for any collection fee. I would like to reiterate that when I purchased my car I was sold PPI. At the time I was self employed so I should have not been sold this policy. I have been miss sold this product. With this in mind I request my car be collected from my home address as the showroom where I purchased it from is no longer open. I also request that no further liablity from me to you is chased due to the fact that I was miss sold PPI. I believe this makes my contract unenforceable in a court of law. As my contract is unenforceable I am allowed to claim back all my instalments I have paid you. With all this in mind I request my car to be collected and my account be closed with no liablilty to you. Thank you for your time and I look forward to your reply. Your's faithfully, Sidewinder" Thats what I would send. |

fantastic i will do a cut & paste on that thanks but one quick question...if i have been missold the PPI..and you deduct the £3k (roughly)i actually own the car then as i would have paid almost £6300. the car was only £5700 + interest or am i missing a BIG point? |

ive had the assessor ring me at home and ask to see my car. i naturally said no as i was using it still for work but have asked him to come back this week. now i have cleaned/washed/shined the beast ready for an inspection!!...do they drive them? as i am not wanting anything to go wrong before they take the damn thing back |

Good point. Might be worth mentioning this in the letter. If you do then you can indicate you want to keep the car as you believe you have paid for it. |

still wiating...had my inspection today..few minor scratches but otherwise good overall. my car at most is probably worth £2k (W reg with 75K on the clock) so i have actually paid £4650 of a £7440 car and also £1800 so far on insurances. knock of the illegal insurance i have and ive already paid over £6500. the person i rang yesterday still reckons i owe over £4000 left...hmmm DONT THINK SO!!!!! W reg car + £4000 left on installments= VT!!!!!!!!!!!!!!!!!!!!!!! on the grounds of waste of money at the end!!! |

have they taken the car today as well? did you take pics of the vehicle inside and out cos other people have had "good" inspections but are still receiving letters for payments for damage. Please remember to take some before handing the car back. have you asked them to explain where they get this £4000 outstanding balance from? |

no they havent taken the car yet...this £4k came from the guy yesterday when i enquired about the balance...i told him about the 2 options they had after i had legal advice...of which he said he couldnt comment. only thing he mentioned was that he sounded surprised that i was sold PPI when i told him i am self employed i have taken a few fotos but will take a shed full more before it disappears |

Mines due to be taken away on Monday. Everyone mentions inspections? No one has arranged to do an inspection just to collect the car. What happens in the inspection, what is checked? Body work, interior, engine bay etc? |

well they are speaking to the collection department to arrange a date for the car to go...ever get the feeling u have been kicked from pillar to post??...they said that my PPI & GAP insurance WOULD have paid out as i was self employed but gave me the old chestnut of "who witnessed the conversation about the insurances"...anyway...they are forwarding my case to the complaints department to sort out . i cancelled my DD so they can whistle for any more money...take me to court ...i dont care for the PPI ...the truth is out there and will put egg on their faces!

when querying " the privy to conversation" debate, is the onus on YCC to prove that i am telling the truth regarding what the saleswoman said in regards to "i have to have the PPI to secure the finance"?? |

just had a phone call from the collection department asking would i pay the £80..when i said no they hung up...what do i do now???..the car has had an inspection too
