I purchased a car from Yes Car finance in Oxford two years ago (April 2005). I am
hoping to return this car in a month's time.

I believe that they would expect me to pay the GAP shortfall- for a period when I
won't have the car - are they allowed to do this?

Also, I did not get my car serviced every 6 months as they say we should do.

Please advise on this --Your website is great!

Hi Gaynor and welcome to our forum

1) Unfortunatley you will have to be pay the GAP policy up, you can either do this via maintaining your installments for this part of the agreement or pay it in a lump sum and the interest element will be rebated.

2) Don't think you should worry about the car being serviced as long as it is in reasonable condition you should be ok.

GAP is a difficult one to argue that it was mis-sold so, be grateful you can get out of the car side of the agreement and juist try and pay the GAP off asap.

if its only the GAP you still have to pay for then you should count yourself lucky in most respects because this was the cheapest insurance policy that YCC offered.

with regards the servicing as long as it does not go over when the manufacturers say the car should be serviced (my fiat I had from YCC was every 12,000 miles) and the car is in reasonable condition you should have nothing to worry about
