We bought a car on hp from Advantage Finance in March 2006. At the time we got the car we was private renting, we received an email from our landlady in June 2006 saying she was putting the rent up. And we decided that we didn't want to carry on renting the property. So we moved back to my husbands parents. And the only way we could go forward was to get a mortgage. In November 2006 we rang Advantage Finance asking them to come and get the car as we could no longer afford the £330 payments each month with paying for a mortgage and other things on top. Also at the time they said that 5k would be knocked off when the car had been returned to them. We offered at the time £25 a month to pay off what we owe. And they refused it. And send a letter saying they wanted £8k. Last week however we recieved a letter from Northampton Courts that Advantage is taking us to court for £14122.98 + £250 court fees. Now looking at the original agreement with them this is the figures that is on there: Car £7500 Total charge for credit £3981.92 Insurances £4720.32 We paid £500 deposit by trading in our old car. Up to the date we rung them to collect the car we had paid £1884.26 So now my question is how the hell do they get we owe them £14122.98? When they received the car back they should have taken off the insurances and the car just leaving charge for credit to pay. It's like they are trying to con us out of paying for two cars we don't have. We are disputing the claim with the court. We have asked for sums to be re-calculated and to have judgement set aside as they have refused our offer. Also when they sent out the claim form, my husband got his, but they sent mine to the old address we used when we got the car. Can anyone advise please. I been worried sick all over the weekend. |

Cheybies, welcome to our forum,Basically what Advantage have done is charged you for the whole agreement minus your instalments. I would have thought they should have accounted for what they sold the car. This would have usually been sold at an auction. Their original quote of £8K suggests they have done that. Regarding the insurances I wonder if they have done the same to you as YCC have done to our users. They will claim they have brought the insurances up front from the underwriting and they are none cancellable. Therefore you are liable for all of the insurance cover of the agreement. It seems to me this is what they are doing. You have an argument in the fact you have a letter saying it should be £8K not £14K. Something tells me along the lines their admin guys have made a mistake. Chances are a judge would order you to pay £8K but dont quote me on that. We are not familiar with the Advantage contract so its difficult to judge without having a look at it. If you want we can get our experts to have a look at it. They will check to see if it can be challenged. You never know there might be a chance the contract is unenforceable. |

Thank you for your reply. Only problem is i threw out the letter about the 8k But i really do think they have made a huge mistake with what they are claiming for. And i still think 8k is alot of interest where the car was £7500. It doesn't seem right that there is more interest than what the car was. Also on the agreement the whole thing totals up to £11481.92 It really doesn't make sense the 14k it has really confused me. And I am hoping that have made a huge boo boo and the judge throws it out. |

I would just outline your concerns as you have done in your post here. I would go down the excessive charges route with this one and mis selling of insurances. Explain that the cost of the car was 7.5k and you would like to know how they have now calculated that the outstanding balance is now nearly 14.5k .. and they have had the car back. I am sure that the last people Advantage will want involved is the FSA at this moment in time. Car dealerships and Finance companies are very, very, paranoid about them right now and will do anything to avoid there involvement. |

Ok i have written this email please let me know that it's ok.... Account no A21884 Dear Mr Charlton, We got a car on finance with yourselves March 2006. In November we rung yourselves to say that we could no longer afford the car due to a change of circumstances.And asked politely to take the car back. The lady on the phone said they would knock off £5000 for the car and would leave £8000 left to pay. My husband offered to pay £25 a month as that is all we can afford as he is main income earner in our house. The lady refused our offer. And now we see that you are taking us to court over a substantial amount of £14824.02. The car itself was £7500 Total charge for credit £3981.29 Insurances £4720.32 Total amount payable £11481.92 Up to the day the car was taken away we have paid £2384.26 which includes £500 deposit. When you had the car back £5000 should have been taken off any monies we owed. The £4720.32 for insurances should have also been deducted. As you can see from the sums it has shocked us that you are trying to claim £14824.02 + £250 court fees. The original agreement didn't even come to that amount. So why is your company trying to make us pay for two cars that we don't even have? We are disputing this with the court also. And have asked for sums to be re-calculated. We want this matter sorted out straight away and amicably. If this matter does not get sorted out we will have no choice but to report Advantage Finance to the FSA. We have tried on several occasions to offer yourselves £25 a month to pay what we really owe and it's not the £14824.02 that your company says it is. I have the bit where it says about reporting Advantage Finance to the FSA to we will have no choice but to make an offical complaint to the FSA. I also changed some more: We have tried on several occasions to offer yourselves £25 a month to pay what we really owe and it's not the £14824.02 that your company says it is. It seems your company just wants to take people like us to court to put a CCJ on us which is very unfair as we have made the offers. We want the CCJ set aside as we have made offers to your company. It seems that not only has your staff made a mistake in figures but they also made a mistake in sending my court claim to our old address when we got the car. Your company was informed of the new address but yet it was still sent there. My husbands court claim went to the right address. |

Recieved letter from Advantage regarding the email. Wednesday 21 March 2007 Ref: Dear Mr Tribe Thank you for your email dated 20th March 2007, the contents of which we note. Please be advised you currently have until 2 April 2007 to reply to the N1 notice of issue. It would be appropriate for you to address any concerns there. Assuring you of our best attentions at all times. Yours sincerely Legal Department. What a load of crap. Assuring us of there best attentions. Well heard back from the court regarding our defence. They still want it to go to court. So I have just emailed them saying: Account no A21884 Dear Sir/Madam Please can you send us copies of the statements on our account and also all correspondance that you have sent us since we opened the account with yourselves and especially when we gave you back the car. We also ask that you send us a break down of the £15074.02 that you are taking us to court for. Regards Mr Peter Tribe On the defence it says Advantage is suppose to try and resolve the problem between ourselves as we have disputed it. But they haven't contacted us at all to negotiate in any way. I'm wondering now what will happen? I read from the letter that if Advantage wants to still proceed then the hearing will be sent to a court near us, is this correct? Please advise. Thank you so much for your help. |

That bit I do know. They will allocate it to a court near you. Obviously not much help from the top man then. I certainly think something is a miss here. It will be interesting to know how they work it out the amount you owe. Until you get disclosure there is not much you can do. If this disclosure does not come before the court setting then surely their claim will be thrown out. Until you get the disclosure

Yes I do. When you are on your way to court you need as much evidence as possible. Are you going ot challenge the validity of the contract or just the amount they are claiming? |

We are disputing the amount they are claiming. I will get a P/O off to them first thing monday. I hope that will frighten them and make them realise that I do know the law. |
