my self and my husband purchased a car from YES in 2003. we were told before signing the agreement that my husband would have to take out the PPI because he is self employed. We signed the agreement got the keys for the car and all was rosy. Until... my husband had no work coming in, it was november 2003 and i was ready to give birth to my second child at any time so I wasnt working. We phoned up to claim on the PPI only to be told we couldn't make a claim because he was self emploed and the policy didn't even cover self employed people. So we scraped by to pay the monthly instalmens of £210-00. In the new year I was looking through the paper work I recived off YES when we got the car, only to discover that we were going to be paying £10500-00 for a T reg Vectra that was only worth £3500-00. The finance on the car was onlt £5000-00. The rest was the damn PPI. When reading the bit at the bottom of the page that said 'Your rights' I relised that once we had paid x amount of pounds we could hand the car back with nothing more to pay. When we reached that figure, sothing in the region of £3865-00, we phoned YES and told them we wanted to make sure we had paid enough to end the agreement, they said yes. We took the car back and even checked again in person that we had paid enough back and again told we had, so we happily handed the keys back and left. We herd nothing from anyone for about a year, then we got a letter from GODEBT demanding nearly £4000-00. When I explained that we had handed the car back with nothing owing I was shocked to be told that we were only £91-00 short of the amount that had to be reached, therefore we were liable for the outstanding balance, the majority of which is PPI. I recieve letters at least once a week and threatning phone calls every week, telling me that they are going to reposess my husbands van and tools ( which he cant do work without) and make both of us bankrupt, or they are going to send the balliffs in. I actuall y felt quite threatened by some of the phone calls. They told me to ask family members for money or try to get a loan to pay the debt, If I could get a lump sum of £1900-00 they would clear the debt, BLAH BLAH BLAH. I am now waiting to hear from them as the last phone call from them I told them I could only afford £30-00 a month, But since I discovered this site today I am not even going to pay them that. I am going to claim back every penny of the MISSOLD PPI plus intrest. Thanks for letting me get that off my chest. hope to hear from someone soon. ps sorry if it took you foreva to read my blag

I have created your own thread.

First of all do not pay Godebt a penny. You have a classic case of being miss sold PPI abnd I believe we can reclaim it back. Also I believe because of this that your contract could be unenforceable.

May I suggest you send a SARN to YCC and Godebt. You need to gather all the paperwork they have on you. Feel free to use our template: -

YCC/Godebt are obliged to respond to this request under the Data Protection Act. They have 40 days to do this.

I do know of a case where someone like yourself has been successful in reclaiming PPI.

In the menatime I am goingot seek some advice regarding the best way to go.

Message for Mr Rhodes. Please fulfil your obligation if this user requests a DPA. If you dont I will personally take it in my hand and ensure the appropriate authourities get to know this which will cost your company dearly.
