Hi, a made a post on here about 6 months after a running email communication with one of GoDebt employees. The emails seem to be the norm now from this company. Wanted £5000 and not excepting installments, telling me they will make me bankrupt if I dont pay the £5000. Everyday for about a week I would receive an email in the morning saying I must reply to them that day or they would progress with bankruptcy. They also told me to take out a loan to pay them off. After I posted the emails on this site and asked for a copy of the credit agreement, all went quiet, untill now. Had a call from a guy who to start with sounded ok, saying there had been a breakdown in communication and he wanted to help resolve the issue. As the conversation continued, he started to turn when again I said I cant afford the £5000 lump sum. When I asked for the credit agreement, he said if I progressed down the route of requiring it, all offers and discounts would not be valid anymore. He then started asking about my credit rating and started to put presure on me saying that there are loan companies out there who would loan me money to pay them off. This pressure went on for a while until I kept insisting that I wouldn't go any further until I had the credit agreement. He has now sent me a single page scanned copy of the agreement, detailing over £2000 worth of insurance products that I signed for (only signed as I was told I couldn't have the car unless I took them out). Question is, what do I do now. I reported them to the appropraite authorities 6 months ago and I am about to request a copy of all information under the Data Protection Act, but do I need to get the Credit Agreement checked to see if its valid or anything? sorry to hear they are contacting you again. this attitude they are displaying is disgusting. They cannot tell you that you must take out another loan to pay off your debt to them - this is just wrong. I would get all the info they hold about you and then if you PM Bakedalasker he can tell you where to send a copy of your agreement to so we can get an expert to check it over. |

They are clearly breaching the OFT Debt collection Guidance, 2.6 (f) pressuring debtors to pay in full in or in unreasonably large instalments? I am also assuming that they didn’t recommend a company to take the loan out with? Also if i remeber right from the 6th April you should be able to take complaints to the financial ombudsman services, as debt collection agencies will come under there remit from that point. The FOS can award compensation payments for distress etc (although they are usually very small amounts), but also it is the creditor who has to pay for the complaint to be dealt with (I think it costs them about £2-300 a complaint?)

Contact the OFT in London give them full details of the convesation you had and name the employee you spoke to. Ask them the procedures to complain and request the OFT investigate this practice. Any breach by Go debt of the OFT guidelines or CCA must be reported to the OFT. The question you must ask the OFT is are they fit to hold a Consumer credit licence if they constantly breach the terms. Action is very shortly to begin against Go Debt so any info you can provide the OFT or DTI will help. The action is a request to rescind their licence and put them out of business. So now is the time.
