Hi All I wrote to DAF on 5th March using the template letter from this website. I can trace that it was recieved by DAF the following day 6th March and the enclosed cheque for £10.00 was withdrawn from my account on 12th March. I still have not recieved the documents and have had no correspondence from DAF. How do I proceed from here??? |

I would send them a complaint letter informing them the £10 was for the SARN. Also inform them you will be reporting them to the ICO for none compliance of your SARN. Naughty people those DAF lot. |

I've just reported my bank to the ICO but from what I can make out from the ICO they dont penalise these companies for failure to comply, but just ask them again to provide the information that was originally asked for.....they then get more time to comply!!! |

Sent Complaint to ICO today and a letter to DAF to remind them that they have again messed up. Lets see what happens now |

Still no reply from DAF. What should I do? Should I keep hasteling them for the Documents or should I just leave it lie and wait for them to contact me. Then use their time delay against them if they come demanding again. Any advice appreciated. Shane |

ThereNo I have not had any reply from either. Granted it has only been a few days since i sent it but I know thatif DAF wanted their money they would be hounding me on a daily basis. What I cant understand here is that I never refused to pay the debt, even though we all know it was mis sold to me. The car is gone back so there is no problem there, I have aknowledged that i need to pay a few hundred pounds to reach the half way mark but they still refuse to give me the information i want. Do they want to sort out this account or not????? Shane |

Some of our users had to wait several months before DAF got in touch with them. Some waited then received a bankruptcy threat from a well known DCA. So the car has gone back which DAF cannot deny. What we dont want is some court action threat claiming they have sent you the info etc. I have e-mailed our legal advisors on this situation and as soon as I hear anything I will let you know. Meanwhile lets just wait a few more days and see what happens. |

Hi All Well still no reply from DAF or no sign of the Documents i requested even though the £10 i sent them for the SARN has been taken from my account. Indeed no reply from the ICO either. This morning I have however recieved a letter from RED CASTLE RECOVERIES informing me that they now have the debt and that their client DAF will accept half the 'Debt' as settlement. What do I do now?? Shane |

Not doing too well hear. Typical DAF cashing in on your money like that. Did you use our template for the DPA? I'm seeing if we can put this into dispute until we get your DPA info. Just hold fire for the moment. |

HI there we were offered the half setttlement and well they say we can pay: in one lump sum 3 payments over 3 months or monthly payments but they wont accept the amount we offered and said we will be hearing from teh legal department soon. we not having much luck either with them gavin and amanda |

Hi Baked Yes I used the template on this website. I sent them a letter when the 40 days were up reminding them that they were in breech or the DPA regulations and also sent a complaint to the ICO. The funny thing about all this is I have not at any point refused to pay this account. All I want is the paperwork and they will just not send it. I keep telling them to send me the paperwork and they will recieve full payment but they wont. Then they send me an offer to pay half. HOW ODD... Anyhow ill hold strong untill I recieve the paperwork and untill i hear from you baked. Why do they have to make everything so difficult. If they keep going like this they may just recieve no payment at all Shane |

Spoke to Redcastle today. Explaind that I have sent my SARN to DAF and recieved no reply. They contacted DAF who said that they never recieved the SARN eventhough they have cashed the Cheque for £10.00 and I have confirmation from the royal mail that it was delivered. Redcastle have asked me to send confirmation and a bank statement to prove that It was requested.; Should I send it Very nice guy in Redcastle I must say Advice appreciated Thanks Shane |

Cannot see in any harm in doing that. Send them a copy: - 1. Proof of delivery of DPA. 2. Careful with bank statement. Obviously blank out all personal details like bank account number etc. At least this will show to Redcastle how unprofessional DAF are. |

Hi I wrote to Redcastles setting out all my issues ie 1 I have asked for all my documents in a SAR and not recieved them 2 I was Missold the Insurances 3 Deposit was taken off Insurances not Car 4 I have made every effort to pay and keep telling DAF that I will if they supply me with the documentation to prove that I am Liable Low and Behold got a letter back from Redcastle telling me that due to the nature of my problem with DAF they are returning my file to DAF. They however say that they have liased with DAF and DAF claim that they never recieved the SARN Request. I however have the copy of the signiture of the person who signed for it and have details of account my cheque was lodged into. Guess who owns the account. I dont think i have to tell you do I I have written to Steve Plowman explaining all this and am awaiting his reply. The ICO are also Investigating on my behalf Ill keep you all postyed as to what happens Keep safe Shane |

Nice one Shaun, well done. So Red Castle have handed it back to DAF. No surprise there. You are not the only one in this situation and I have a feeling Red Castle will be doing that to a few more. Hopefully they will realise that doing business with YCC/DAF is not good...just like Godebt found out. I wonder if Red castle will own up to this...unlike Godebt. |
