yeah dont worry about ycc passing debt on, mine has been to 4 dca's now lol

I just tell em its in dispute and with solicitors, they soon pass it back

hello Folks

I have at last recieved the Documents from DAF. It contains and I Quote "Copies of all Scanned information held in relation to this account"

It is Catagorised into three catagories

i) Chat system notes
ii) Statement of account
iii) Documentation taken at the time of the original application

I have written back to Mr Plowman to find out where all the information about the alleged Insurance is and am awaiting a reply.

There is however two documents confirming that the Deposit was taken from the car one being the "NEW AND USED VEHICLE ORDER FORM" and the other is an invoice stating clearly that the deposit should have been applied to the vehicle and the figure that was due from the finance company is incorrect on the contract.

I am awaiting his reply

Shaun, this is the proof you need to show that the contract was improperly executed.

Would it be possible for you to scan this copy over to me?

Hi

I got a letter from MR Gilhooley today. In it he says that the insurances were part of a Master Policy and that they cannot send me details of any individual policy.

He also says that it is clearly stated on the Agreement that any downpayment will be taken from the Insurances.

Any advice please.

Shame, when did you buy the car from YCC?

I would ask Gilhooley where this is stated on the agreement. Also inform him you have extra documentation from the SAR that indicates the deposit should have been taken off the car.

He most liekly does not realise you have this proof. Just goes to show what a bunch of imbeciles we are up against. This will come back ot haunt them.

I bought my car in November 2004.

They have sent me sone kind of photocopy of terms and conditions but i can hardly read them.
Ill have to see these guys in court I think.

Still not got any proof that i ever had any insurance policys just a load of numbers from gilhooley

"You will note from the enclosed copy of the terms and conditions of your agreement,section 4 additional insurances, which clearly confirms that the down payment, will be used to pay the premium(s) shown in box 3."

Does this not prove that I would not have been sold the vehicle if i had not taken the insurances as any down payment has to be taken off them. I now have proof in the form of 2 pieces of paper that the insurances were taken from the vehicle and confirmation from Mr Gilhooley that this was incorrect and should have been taken from the insurances.
I also see that when i bought the car on the first day i showed my contract of employment which stated that i would have a permanent position subject to satisfactorly passing the training course and a further 12 Months probation. There is however no record or copy of my contract of employment when i recieved the documents throurh the SAR.

Do you know Shane this is a very good point you make here and one that I have never thought about :P

You may be on to something here with this and maybe this fact will highlight a bit more that surely the insurances WERE compulsory because they asked everyone for a deposit
