Help, Car Broke Down

I brought my car from aproved car finance on the 12/2/07, it broke down 8 days later with a faulty water pump. ACF took the car to their garage for repair 18 days later the car was returned. 2 weeks after that the car broke down again with a water pump fault. This time the finance company agreed that I could have the repair done locally at there expense, however when they done the repair they found that

a) the water pump had not been replaced

b) they had changed the head gasket

c) they had put the old cam belt back on

d) they had missed off a bolt

e) I had to front tyres nearly illegal

f) there was misting in the gearbox

g) my fog lights weren’t working

Local garage have said due to old cam belt being put back on, this car was a death trap, if the cam belt had snapped we would lose all electrics including breaks and power steering.

The finance co have said they will not cover the expense but ACF will, the car has now gone back to them for investigating.

During the first repair I had to hire cars as I work out of town at my expense. And now I am having to do this again.

Also on checking all through my papers I did not get the £1000 trade in for my old car this was reduced to 1 pence because of tax? Strangely this was after we had been persuaded to up my deposit to£1000.

The mechanical breakdown I was advised to take out only covers £300 worth of repair and the list of things it excludes is longer than what is covered.

Total cost of having my car for 2 months

Deposit 1000

Advertised Trade in 1000

HP instalment 356.22

Hire cars 552

Telephone Calls 50

Total Cost 2958.22

Do we pursue legal action? Will a solicitor take this on? Or do we allow them to look at car and then fix it, possibly sending back a death trap?

Please help.

hello Laura,

Personally I would demand all the money back you have paid and to tell them to keep the car. I would quote them the Sales of Goods act and inform them the car was not "fit for purpose". If they dont agree threaten them with legal action.

Your first port of call for this situation is they play difficult is Trading Standards. Might be worth giving them a call first before doing anything. We know of a number of cases likes yours where they have sorted issues out like this.

If you dont get anywhere with Approved or Trading Standards them let us know and we will go from there.

Firstly thank you for your reply.

Trading standards say they will only intervene, if whne ACF fix the car again and then we take it to a garage to have it checked and then it is still deemed faulty, then they will step in, until then they say we should stick with what they want.

As you can imagine this really isnt what we want as it will be a long and costly process.

Laura, just had our legal expert look at your thread.

The advice given is that you need to get an Independant expert opinion on the car BEFORE you get it repaired. This will look good in court if you have to go that way.

Going on your posts it looks it looks a reasonable case in your favour.

If you want further advice please let me know.

Right, thye would not allow us to look at the car before it went back.

It is currently at their garage, nothing has been done with it, as no garage reports, so will assume its just sitting there.

They have now asked for it to be returned to our local garage, to be stripped down (Why they have had it for nearly 2 weeks doing nothing, we dont know)

Once stripped, it will then be decided.

Worrying thing is, if it is stripped, and they somehow say it was something that happened after we have had it, we will have to pay the bill..Looking at £700.

So where to now?

All legal advice here, is saying we have to allow them time to look at it and sort it. they say 3 weeks is reasonable?

What to do now Do we let it go to garage, which will be saturday? or do we stop it (not sure we can), because what happens if it goes and we end up paying?

Help please.
