hi all 2 years ive been fighting these buggers anyway been to court today ive argued my case that the 500 deposit should have been put towards the car payments not the so called optional insurances anyway the judge dismissed there judgement against me so we are going for a full trial which should be fun could any one else send me a quick note if anyone else as managed to get the court to buy the money for the deposit should go towards the car and not the insurance as it might help me when i go for round 2 with them,just to also note there barrister was a muppet didnt have a clue what he was on about kept telling the judge to wait while he finded is relevant paperwork he asked him 3 times if the deposit had gone towards the car would i have been over the third bracket and didnt want to reply untill finally persuaded by the judge//. |

Right. You mentioned the barrister being a muppet. I have received other stories from users of this forum who claim the same. One of our users spoke to the barrister who claimed that DAF instructed her a day before the hearing. Perhaps the same happened to this barrister hence the fumbling of the paperwork. I do get the impression DAF are struggling with all this. We are going to have to see how they perform at the full hearing if they turn up. Got a feeling they will do a deal with you before hand. Anyway leave this with me and I will see if we can use this to our advantage. Be back soon. |

hi yes on the direction of a very nice person from trading standards,the judge did say to the barrister and me we should try and come to some kind of resolution but i dont want to make the first move yet let them stew a bit as they have caused me so much trouble over the past 2 years |

jamie, Is the Trading Standards people aware that your contract could be unenforceable within a court of law. This might be a good bargaining tool. |

yea apparently they have picked up that ycc never sent me a second copy of the aggreement as well and we have evidence in there chat notes they never even served the contract on me properly,i have managed to get this in to my evidence and sent a copy to golds solictors and also a copy to the court and ive asked them in no certain terms to refund my payments or we will see them in court for the full hearing so im not giving in with a right fight!!!!! |
