Hi,

Right... Here goes...

I'm going to be 100% straight with you guys here.... So please be patient...

I bought a car from CARCRAFT last year through UCAN, I never took out any PPI or no insurance, 2 salesman hassled me and I went into a monologue leaving them standing there scratching their head, that I was quite proud of....

Anyhow, I bought this car in July last year over 4 years, I am going to scan my agreement and stuff and show it to you so u can see for youself...

Anyhow, the engine kept on overhearing over christmas and when I looked further into it with a VAUXHALL ex worker, he noted that the car hadn't been serviced in the time the previous owner had it, no stamps and nothing.. Nada..

So that made my manufactuer warranty null and void, as it was and is still under 3 years old...

Now from yesterday I had to cancel the DD with my bank, im off work they are not going to pay me my full wages and well I cannot afford the car, and it looks as if I cannae go back....

Now...

What do I do?

I cannot make the repayments, so im in dire straits.. The car they sold me was a shitbin and its all crap!

Now, there 125 point (whatever that is) pre-delivery check is a farce, if the salesman had explained to me that the car had not been serviced by the previous owner I would not have bought it, true, I should have checked, but I am under the understanding that these guys where trustworthy and that they where selling me a decent car...

However, I did not get the log book, I did not get no TAX I did not get a chance to inspect the car and I have a document here, which is basically putting a sham to there delivery checklist...

I have it here.. Look...

Maybe I should have acted earlier, but as I said, i am in dire straits and I have to explore every avenue...

I dont know what you gusy think, but I think thats just "poo"!

They would probably get away with that, but if I deviate or anyone else for that matter against what we agreed to, we would be help accountable, I see no difference at all between me and them, just this silly bit of paper...

hello Lasaruseifer, welcome to our forum.

My first thought is that you need to contact Trading Standards regarding the condition of your car. As you have only had it for under a year I would say they could have them with the sales of goods act as the car being unfit for its purpose. Elaborating on that I would get an independant report done on the car. This will be useful if its ends up going to court.

Regarding the agreement we are not familiar with the Carcraft/Ucan contracts. But we do have legal experts who can give us an opinion. We provide this service for free and will give you a clear indication of your chances of challenging the contract. This site is very sceptical of this company Carcraft/Ucan. We know for a fact they have employed ex YCC employees including managers. We have been approached by their PR company so they are aware of us. Our reply to their sent message to us was ignored. Our first impression is that they behave very much like YCC and we will be taking interest in them very closely

I have had a quick look at the calculation, and run it through the calculator on the FSA website http://www.moneymadeclear.fsa.gov.uk/tools...calculator.html

if the intrest rate is correct at 15% then the monthly payments shoould have been £146.11 not the £180 they were asking, this would then have the affect of making the payments wrong and you would argue that this would make the agreement unenforcable as this is what is termed a prescribed term.

I would take your contract to your local TS office and ask them to calculate what your payments would be if the intrest rate is right ( the calculator on the website isnt the most accurate) if the figures are diffrent getting written confirmation of TS and take it to your local advice agenecy and they can write on your behalf.

Spud - I don't get it mate, where is this interest rate of 15% from?

I am sure the APR is 30. odd percent.

Dont worry about the contract coming through, it already has. Just my ISP playing tricks with me.

The 15% is at the bottom.

Hi Lasar,

Ok we have had our legal experts looks at your contract and there does not seem to be too much wrong with it.

However, the car being faulty may well give you opportunity to challenge the agreement anyway. We recommend you do not surrender the car and try and get an independant expert to inspect the vehicle. Perferrable someone with experience in court action.

Can you clairify if you were sold the manufacturers warrenty with the car.

No, I have not contacted then yet, afaik, yes the car was sold with Warranty, but they could say that they meant their warranty...

So, u think I should get it looked at?
