hi just wondered if you knew if i could claim all my ppi back for a car i bought 2004 and they repossessed it 2005 i was self employed, does it even cover you if you are self employed. i still owe over 7000 only missed 2 payments and they came knocking on the door 7am one morning and took it. wouldnt mind it was only worth about 1500 when we got it but thought getting one from a company instead of ebay would give us some rights |

Mrsa0412, welcome to our forum.You will need to check your Terms and Conditions before we can answer that. Apparently there were 3 levels of cover and without knowing which one they gave you we cannot really judge. When you took out the agreement with YCC was a time when they were wrongly executing ing their agreements. Chances are that the contract you signed is unenforceable. As mentioned all over this argument there are a number of legal arguments against these contracts that are causing YCC to set aside the chase. Before I go any further could you let me know exactly your situation at the moment. Do you have any legal representation? Are you being chased by a debt collector for the money. we pay 50 a month and i think we will be till we die. pay through direct auto finance. also am i right in thinking that they should have gone through the court before they came and repossessed the car. we had no notice they just turned up and took it. |

The contract is over 48 months. For them to apply for a court order you will need to have paid a 1/3rd of your agreeemt. This basically means 16 instalments. From your OP it loks like you only had the car for a year so no they would not need a court order. What they would have needed to do is issue you with a default notice. Do you recall getting one of these? My advice to you now is to contact your local CAB and ask to speak to one of their specialist advisors regarding your YCC contract. As mentioned all over this forum their are a number of legal arguments agianst this contract that are causing DAF/YCC to backtrack. You need to find out if you have a case or not. As you had taken out the insurances the chances of you have a case to fight are high. The more this episode goes on against YCC the more the lawlords are finding out about them. It can be a long raod but it just might be worthwhile going down it. Let us know what you want to do. |

going to call cab tuesday. think i can get all the insurances back plus interest because i'm self employed so i was never covered anyway. is it the wording on the contract that cab look in to? don't know how anyone understands it its like gobeldigook. |
