I have reposted this im sorry I posted in the wrong place Hi all could you please clarify some things for me.......... In June 2003 I went to yes car credit for a car I dont think I had bad credit The apr was 19.9% I went to yes because my car broke down and died and as I am self employed I thought it was my best chance I was desperate no car no job! When I went they told me I HAD TO TAKE OUT THE PPI or i wouldn't get the car, i thought that I may be able to cancel 14 days grace, so I rang to cancel the PPI within 4 days they said no quite rude and abrupt and that was that. Now I only have two more payments left so I dug out the paper work, No paper work for PPI, my sister called and I told her two more payments left being nosy she looked over the paper work and told me that the PPI is extortionate £4700!!!! She told me that it is illegal to force me to take on the PPI is this true? Also I have been self employed for ten years does this count as miss-selling the PPI, I have no PPI paper work to confirm this does anyone have any suggestions. To add to my anger the yes car credit employee pursued me to go with him to a cash point and double my deposit and now I realise this was a deposit for insurance. I know I am to blame for being stupid but looking back I feel like I was pounced on by a vulture when I was at my most desperate. Any advice would be much appreciated thanks in advance Penny |

Hi Penny, welcome to our forum. First of all there is a good chance that you have been miss sold PPI. Being self employed is the key here. I do know of a case where someone like yourself got the PPI refunded because they were self employed. As far as forcing you to take out insurances I dont think we can use the word illegal. It is a hot topic this forcing clients to take out insurances as you might already know. Even so to reclaim your money requires more work than just writing a complaint letter I'm afraid. The norm is to threaten court action and see it through. Before we can advise do you have your terms and conditions for your PPI. We need to check this to see if you were not covered being self employed. We know YCC had 3 levels of cover so we need to check which one you got. You mention you have 2 more payments left. Therefore I would advise you make these 2 payments when they are due then consider reclaiming your PPI if we find out you have a claim of course. Can you let us know exactly what you have in terms of paperwork. |

Hi again thanks for the welcome baked, sorry but I have to rush this. I have a green booklet mechanical breakdown I have two copys of the credit agreement its green I have nothing else!Ok at 19.9% £185 per month towards vechicle installment Again 19.9%APR Aditional optional non cancellable Insurances + deposit £650 it totals around £4600. I guess I will need to send of for my data protection files I have found the template, thanks for that. Could anyone please shed anylight on what my chances are of reclaiming the PP insurance if it was miss sold as I have been selfemployed for 10 years. I am willing to go to court as I feel like they have taken the p@ss. Although It has crossed my mind that the judge may look on it in a bad light on my part as when it gets to court I will of paid all and agreement finished (ie) why pay for all this time and raise the matter when paid in full. What I may do rather than give them the 40 days is to ring Yes car credit tell them I need to claim im out of work and see if I am covered what do you think? Regards Penny |

can I just say that this thing about the "optional" insurances causes a problem. By law they are doing nothing wrong in making them non-cancellable, this is because the agreement has been signed on their premises. However the way they were sold is wrong because everybody has the right in law to be able to take that agreement away, get it independently checked and then sign it. Why did YCC not allow people to do this? because they knew how much of a con their PPI was. if you claim and then find that the PPI does not pay out then you have 6 years to complain and raise any grievances about the agreement (this is another legal fact). The law states you have 6 years from signing the agreement or 6 years frm when you discover a problem with the agreement whichever is longer. |
