Hi guys

Took Finance out March 06 due to family change of circumstances stopped paying them about June 06 they came to my home and i explained and asked them to take the car back couldnt afford it due to the change in circumstances as far as i was concerned they were collecting the vehicle from my old address and then would contact me with the balance of what was owed after the car was sold.

Havent heard from them in almost a year now and no car has been collected. Then on about 19th April 07 i receive court papers Claim form and i then acknoweldge receipt online witht he court and also followed up with an email to the court explaining my version of events to then receive an email back from the court saying that they have no record of the reference number i quoted from the court papers claim number etc.

then today 10th May 07 i have received a letter from welcome finance dated 8th May 07 issuing a notice under section 87 of the consumer credit act attaching a defualt notice and asking me to contact them with a way froward for repayment and if i dont then they will take me to court etc etc.


What do i do now im somewhat dumfounded and have many issues and worries.

why has it taken them almost a year to issue a default notice when the car is under a hp agreement so tehcnically they should have repossessed ages ago.

Why when i canceeled the agreement last year did they not collect the car etc etc.

ok so i have defaulted but surely they are now in breach of their side of the hp agreement for not following their set out proceedures properly and in a timely manner?

And also. why have i received a default AFTER i receive court paperwork realmad

Sounds like a right mess. Something has gone wrong on their side.

As you cancelled your liability would be the amount up to the half way mark. So you are liable for instalments up to March 08. Also if you took out insurances you would be repsonsible for the full amount for them.

Sounds expensive to me.

Something tells me they are goingto charge you the full amount for the agreement minus the car sale. So if the agreement was for 4 years your liability would be: -

Full 4 years instalments minus car sale minus what you already have paid. Even more expensive.

So however you look at it its going to be expensive.

I think we need to look at your agreement to see if there is a challenke to all this. Welcome agreements are not that good and alot out there are unenforceable. We need to have a look to see if this is so.

Also worth keeping in mind is the fact you did cancel but Welcome did not do anything. This will not look good in court. Welcome might just want to avoid this.
