Garage Sold Me Dangerous Car - Now Ignoring Me.; rejection letter in post!

hello all, my names paul and i was referred here from the CAG forum.

basically i was sold a car for £5000 from a local dealer using black horse finance for their finance.

i traded in a focus at £1400 and had finance for £3600.

10 days aftrer buying the car it kept stalling, and then a small fire started on the steering column which must have melted a load of wires, as now the elecrics are all over the place.

i had kids and the wife in the car, which really bothered me. so anyway i drove it home and sat it on the drive, and contacted the garage who said that in accordance with their warranty they would sort out a company car and fix the car.

that was a MONTH ago now and they havent:

rang me once
given me a courtesy car as in the warranty
offered to collect (as its now illegal to drive - no horn amonst other things)

so anyway i put a letter together rejecting the car, sent it recorded mail to the garage and black horse. i recieved a letter today from black horse saying thanks for my letter, and they have a quality assurance rep dealing with my case. they said they had forwarded my letter off to the garage.

at the same time i got the letter to the garage returned as they hadnt bothered collecting it from the post office.

so thats me, im going to ring black horse on monday and see where i stand but i just want to hand this deathtrap back as not fit for use and be done with.

the garage was Lomond Car Centre in Dumbarton, and they are proper cowboys. they promised a velet when we collected the car and didnt do it. they said it had been checked for any electical issues, they hadnt. there was a fog light and a sidelight out.

also i noticed that they MOTd it on the day i collected it but there was an advisory sheet issued, they didnt supply it making me wonder what was on it they didnt want me to see?

anyway steer clear of them, theyre rubbish. black horse have been nothing but helpful.

hello Paul, welcome to our forum.

I'm sorry to hear about the problems you are having with your car. Its sounds to me that you need to get rid of this car once and for all and get your money back. We will be interested to see how Black Horse go about sorting this out for you.

In cases like this we recommend you contact Trading Standards. I would imagine they would throw the Sales of Goods Act at them and get your money back. Thats the least I would expect.

Sometimes we recommend you get an independant inspection carried out before handing the car back to the garage. But to be honest with the problems you have I would be very surprised if the garage do try and give it back to you.

If you dont get any success with this situation let us know and we will see what we can do.

Thats great, i did quote on the letter i had advice from Trading Standards, and i have called them in their glasgow office. they basically confirmed the sale of goods act, and how it affects the sale.

so the car has been reportred as dangerous to drive, now illegal to drive iaw the road traffic act (no horn) and i have rejected it.

i will not take their offer of fixing the car as they have had a month do do it and not bothered themselves. a replacement would be laughable to be fair, i want nothing more to do with them.

ill repost on monday after i speak to black horse and my own 'personal' quality assurance officer :)

I spoke to black horse finance today and they said they had recieved a reply from the garage, the garage said for me to bring the car in for them to complete repairs.

I am in no way happy for them to carry out repairs, why should it take an official letter and action through Black Horse for them to repair the car? It has now been a month.

They again, have not contacted me since the faults were reported.

I do not want them to attempt to fix the car, and i wish to reject iaw the Sale of Goods Act.

What position am I in if they are not prepared to accept rejection of the car? Would I have to get a solicitor involved?

I hope not as I do not have funds available to go down that route, but if that is necessary and I have to go to court would I end up paying them or would the garage?

I have now had to buy another car as a runabout whilst this car is off the road.

Getting worried now that this is a little too much for me to handle.

I would speak to Trading standards again about this issue because I am not sure if after so long they do actually have the right to repair the car for you. The law states that any retailer can offer an exchange or refund for faulty goods but it is up to them if they offer a refund. However, as the car is dangerous I can't see why you can't refuse it on these grounds.

Trading standards should be able to help you put together a letter and help you further with this matter. They were very helpful to me when I had trouble with YCC and have helped me with several other companies regarding the Sales of Goods Act

Thats great ill call them tomorrow. The thing is they have had a month to repair the car, and havent bothered themselves, so why should i accept it now is my question.
