hello all after requesting for a cca i had got a reply saying if i had not heard anything then get in touch so 28 days had passed still nothing i requsted for another cca gave them 14 days still nothing so i rang em they had said they are still waiting for it and then i told them that this is still on my credit report as a default it was then removed that day and i just got a confirmation letter from hillesden of removal so weather welcome can still provide this i dont know lets hope not

In your dealing with Welcome finance have you started a different agreement with them from an original one. That is have you started a new agreement carryingon from an old one?

Would like ot know this, cheers.

hello mr bakedalaska no this is in connection with 1 agreement i had started in 2002 which i refused to pay because i realised the car was sh*** and i i gave the car back i defaulted that year the outstandung amount was later sold on to hillesden in 2005 who tried to chase me for it i then i done a cca on em so if welcome cant bring up the original agreement so far they havent then my default will be remaining off my credit file unless it turns up in the near future hillesden say that they intend to be following it up from their client welcome (the agreement)

Thanks for replying. The reason I asked the question is that Welcome have a reputation of making their clients signanother agreement as the original one is usually unenforceable.

Also what we are witnessing these days is that these new agreement....well there are no new agreements. So clients are payimg into a plan with no agreement. A DPA usually reveals this. Saying that I'm only going on other posters testimonies.

So you have done them a CCA request and of yet have not had a reply. By law as you already know they therefore cannot enforce the agreement. I usuallly advise users in this situation to write back to them informing that they have not complied so therefore will not receiving another payment to they have complied.

Chances are if you have already returned your car they will write back to you informing that they have cleared the debt. Something tells me this will be the outcome.

thanks for the reply ok so i hope in my case that as the original agreement is so old (5yrs) that it is unenforceable or it is lost somewhere i hope so coz the car was worth only worth £700 resale when bought and they wanted nearly £7500 including ppi over 4yrs i think next time ill just save up for a car gifwine
