I Need Help With Welcome

5 years ago we got a car from welcome finance after paying for the car for 2 years my husband fell in and had to go on incapacity benefit we tried to claim off the gap incurance that we had taken out from welcome and were told we didnt qualify they reduced our payments and last year we were told we owed 1000 pounds when we enquired last month how much we owe it had gone up to 2700 i have asked for an agreement an havent got it from them yet i have refused to pay anymore untill i get a copy of original agreement we rang them today and were told we cant have the agreement untill we pay this months money in my eyes this is blackmail what can i do ?

Hi She, welcome to our forum.

Well what they told you is nonsense. If you have sent them a CCA request they have 12 days to comply. If they dont then they cannot enforce the agreement. You are not obliged to pay anything until they produce the original copy.

After the 12 days are up I would write them a letter informing they have not complied. Make sure you record deliver this. If they take you to court they will simply lose.

Something here tells me they have not got a copy. It wont be the first time this has happened to them. They are trying it on.

Stick to your guns and dont pay anymore money until they produce a copy of the original agreement.

Have you made a formal request for this agrrement?

If not, submit a lett requesting it and enclose a cheque for £1.
