:( we bought a car through approved car finance in november 06 recently we have had to start paying £500 a month to the child support agency for maintaince so we contacted the finance people first response and they said they would reduce payments for us and we would have to pay half we thought that ok so we paid the half next thing we get a default notice so my husband foned them they said nothing to worry about no ones taking your car your payments will still be £132 a month (half of the £264) next thing we get the termination notice from them we rang again spoke to a manager and he said that what we were told was wrong they THOUGHT we had the car for more than a year our payments will not be reduced and we are in arrears of £132 which they want with the £264 today can anyone advise me plz on what to do thanks

do you have any of this in writing or has it all been done over the phone?

i would write to them with a Data Protection Request (template on the forum) and ask for copies of the phonecalls and any other info they hold on file about you

i would also seek legal advice ASAP from the Citizens Advice about this because now they have terminated your contract they can just come and take the car without a court order and then chase you for the whole amount outstanding on the agreement

Im also having problems with approved (cygnet see post ) i have sent a letter requesting all acount details plus origional contracts /paperwork , the annoying thing a repayment scheme was arranged and it appears the women (trust me im trying hard not to call her something else ) who is my account manager is hell bent on repossessing the car ......
I hope you have sucess in contacting these people as I have found they dont reply to letters ( they seem to have pixies that steal there post as they dont recive them ).....I ve tried E mailing and they never phone back ..or get the manager to phone back....So good luck

thing is if they dont reply to a DPA request then it makes the agreement unenforceable so it would be in their best interests to do so. You can also complain to the Information Commisioner if they don't reply - this may spur them on a bit

i have got the template now and will send that off to them but they are still asking for the £330 payment by the end of the month do i still have to pay this if they have terminated my agreement also i was told wen i took out the ppi and gap insurance i had to have it not that it was optional and havent ever recieved anydocuments about these just payment info

thing is if you don't it will make you look bad if it goes to court.

i would say if you can afford it then pay and make sure you seek legal advice asap.

can i ask have you ever been in arrears with your payments? if not they cannot demand a lump sum payment for the rest of the agreement. you have the legal right to keep paying by monthly instalments

we are in arrears now as they told us last month they were lowering our payments and to pay half so we did that only to be told this month and after recieving default and termination notices that they made a mistake thought we had the car longer than we had and wasnt going to lower payments and thats that i think we may give the car back

also wanted to add that i only got £200 for my car and was promised £1000 + £350 cash back which havent got on my agreement its says cash price of car £3968.00 £200 trade in
£2912.64 intrest
£195 doc fee
£40 option to purchase fee
total charge for credit £3147.64 total payment of car £7115.64 intrest rate 54.59%
which they never tell you about then there theres the ppi and gap that is mis sold to you £1509.31 the charge for credit £1109.33 total for insurances £2618.64 apr 48.84%

so i will have to pay £9734.28 for a y reg focus
they never explain all this to you if they did i think i would have walked away there and then but i am stuck now
