Need Help Not Sure Wot 2 Do; in arrears

hi there first of all wot a fantastic site

anyway my problem is i got a car from ycc in august 2005 the car has had some sort of a problem since the word go (it bunny hops and sound terrible)we have had 3 dianostic tests all say something is wrong but can not pin point but this is not my problem

my problem is i am in the army i have been in afgan since late dec 06 i have only been back 2 wks was informed by my bank that the derict debit has not been payed since jan 07 i rang daf to sort the arrears out but they just hung up on me

while i was away the camp i was living in was knocked down so daf does not have my address so i have not had any letters when i rang they just told me they where not interested and hung up not sure wot 2 do i am supposed to be leaving the country soon for 3 yrs i have to admit i am tempted 2 take the car 2 one of there auction house or offices and just leave it there

what should i do please help

also i do not have all the money still in the bank have most of it but this was not the only direct debit stopped so i have had to pay them and there charges.

hello Benw, welcome to our site.

I feel you have 3 options to go for here: -

1. Although you brought the car in August 2005 I think you have a case for the car not being "fit for purpose". As you have had it tested 3 times and they still cannot find the fault I would contact Trading Standards on this on. Ideally you need to get an independant check on it. This way I think you might have a good case to get rid of the car for good.

2. If you just return the car you will be liable up to the half way mark plus the insurances. Unfortunately I dont think they will accept this as you have defaulted on your payments and they might remove this right from you. If they do that you might findyourself liable for the remainder of the balalnce.

3. Notive you have made effort to catch up on your arrears. If youwant to keep the car i.e. not have it repossessed, then this is a good way to go about it. I wouldwrite them a letter informing you intend to make up the payments. If it goes to court then a judge would lok at you favourable as you have made effort.

As you are leaving the country for 3 years I can see how you are tempted to give it back. I do feel YCC/DAF will cause problems here for you as mentioned in option 2.

As your time is short here why not give our legal experts Stephensons a call. They would be interested in geting you out of the contract and allowing you to keep the car. I say this as they would arrange for an independant inspection of your car. From there they would contest the car is not fit for purpose. Why not give them a call and have a word. Tell them you have been in touch with us.
