Yes Car Credit; miss lead insurance

On the 26-04-06 i purchased a car from yes car credit i was told i had to take out all the relevant cover PPI/Gap Ins/mechanical breakdown.This all totalled to £13,325.76 with finance the car came to £9,023.04.
34402.72 was all the cover i had to take out. In july 06i gave then the car back and the balance was £6735.01 left to pay.
I recently found out this is only the insurance covers i have to pay back i am wondering if their is anything i an do i don't see how i have to pay for this as i no longer have the car
I believe i was miss sold the insurance covers.
The company phoned me up saying i owed this balance and they would reduce it by 50% if i was to pay straight away.I don't think i should pay anything as i was miss sold this.
Can anyone gove me any advice on what to do?

hello Roy007roy,

They are trying to treat you an an "abandoned" case. That is they are trying to get you to pay for the full balance of the agreement.

You handed the car back at the half way mark so you should only be liable for the insurances. So the maximun they should be chasing you for is £2200. Did you receive any default notice for this car? That is did you arrange with them to hand the car back at the half way mark which would have been June 06.

Regarding the unsigned agreements I think you will find that if you do a CCA request to them for a copy you will find their one is signed. They have 7 days to return a signed copy to you.

If they have not signed any boxes then they have not done a good job executing your contract. Can you scan your agreement to me to get checked. Please can you send it to Bakedalasker@saynotoyes.co.uk.

I would also do a DPA request to them. Lets get all the info they have on you so we can start building a case against them.

i have sent the documents you have asked for also they said i could not have the car unless i took out the PPI and Gap insurance and mechanical breakdown. I was forced into doing this because i could not get credit anywhere else at the time also i only went 400 miles over the service time which had to be every 6,000 miles now it states in ford manual book every 12,000 miles because i went over by 400 miles and the car broke down they said it was void and it was down to me to get it fixed so i think i have a good case do you think you can help me?
Also id like to thank you very much for replying and for your help also i kept up with every service and kept the car in A1 condition hope to hear from you thankyou again just one more thing i payed £100 deposit for the car what went onto the insurance i thought it should have been put onto the car

i told them to collect the car july 06 and they did do at no cost i think :lol:

I would have thought that 400 miles over the stipulated is not unrealistic, 1 journey could take that quite easily and if car was booked in advance for service then you could argue your case on that grounds

if manufacturers is 12000 then I would also use that in any argument, your best option is to seek legal advice, dont try and fight on your own as they will just get heavy handed

I am sure others will agree that this is the best course of action

Hi , I to challenged the 6000miles service issue that you have, i was told that provided you have service history i.e manufacturers recommended service times, in your case 12000 miles that would be fine, it is all about written evidence and provided you have that you should have no problems with warranty company, just tell them you are following manufacturers warranty.
I fortunately never had a problem with car that needed to use warranty so it could well be they would have changed there tune at that point ---WHO KNOWS-- they are good at that by the way.
Ask them why when the manufacturer stipulates recommended service times,what exactly is going to be done different? (at half the mileage) any decent garage would take one look at you're service book and tell you that car does not require service, that did happen to me at Arnold Clark.
If you have lost service book with evidence in it,try getting in touch with garage where it was done they should have kept records.

when i had my car from YCC and the warranty said 6,000 miles (although manufacturer said 12,000 - mine was a fiat) I rang MB&G and told them I would be going by the manufacturers service schedule. They said this was fine as long as I had the book stamped every service I had so I think as long as you have done the same you will be fine. I know for a fact there is no point servicing a ford at 6,000 miles. My ford mondeo I just sold went over the service schedule (was not on a warranty) by 3,000 miles at one point and it was still running fine
