First Response; Very small arrears yet HP terminated

First Response have terminated my agreement when I was less than one payment behind £125 arrears and payment is £165. Is this allowed.

I have had threatning letters stating they will reposess the car, I have informed them if they wish to do this they will require a court order as well over one third is paid.

They have kept ringing me at work when I have asked them not to. I have quoted the Admin of justice act and they say they are unaware of it.

My car has cost me £650 in repairs this year and has a rust issue. It is only 5 years old.

Can anyone help me understand if they are in the wrong esspecially with the termination.

P.S. they did send a default notice before hand but was unable to pay

Hi Tavmania,

I cannot give you any answers in regards to your payments but in regards to your harrassment there are some letter templates on the yes car credit website in which one of them involves only accepting correspondance in writing.

The call are quiet now that my account is up to date. But will keep it in mind if they start ringing again.

I just need to find out where I stand legaly with the Default & Termination being for only 30% of a payment in arrears.

i cant see how they can get away with terminating your agreement for that amount. What does your agreement actually say about this - may be worth checking it out incase they have made a balls up on their part. I know places will start charging you for being in arrears but not terminate the contract completely. It seems to me they are being far from reasonable here. You say you are now up to date with your arrears. So what is happening now? Are you still paying for the agreement every month? Are they likely to repossess?

I have the car as they are unable to repossess as I have paid over a 1/3.
They have threatened to take the car but I have pointed out to them to do their calculations.

I have looked on the agreement and it states that if I fall behind they have a right to default etc but does only 30% of a payment constitute as a falling behind.

I am an ex Welcome branch manager and we were not able to Default and terminate untill the customer was 60 days in arrears (200% of a payment).

thats what i would have thought. when i had a storecard with new look they defaulted me after 3 consecutive months of missed payments - 30% sounds pretty harsh. have you spoken to the CAB about this?

I haven't yet. It's the old problem of always at work. What are the CAB like, I have always been under the impression that the advice given if any can be unreliable.

no they have been very good with most of our members when they have contacted them about YCC and they are normally very good at helping people with your sorts of problems - is sometimes just a case of asking to speak to a specialist in that particular field
