Hi. Stumbled across this site, but I think I'm glad I found it! Have a bit of an issue, and any help and/or advice will be appreciated. I'll try and be brief... Bought car in Jan 2005. Made redundant in Feb 2005, and informed YCC. Took car back to YCC showroom, with a letter explaining I wanted to terminate the agreement and call it quits (it didn't follow your template, as I didn't know it existed!). I only made one payment, and cancelled the insurance (apart from Breakdown) within a week of getting the car, well within their cancellation period. They sold car at auction for about 2k less than I paid. Was going through a painful separation and eventual divorce, so really didn't care, and I left my wife and home and moved away. Apparently, the debt was assigned to GoDebt in August 2005. About 4 weeks ago, received a card from Kudos, asking me to phone, so I did. It's a tracing agency. Couple weeks later, received a letter from GoDebt giving me 48 hours to find £5700 odd. Spoke to National debtline for advice, and did the following:- 1. Asked for CCA and associated statements etc (paid a pound) 2. Proof that the debt had been bought or assigned to GoDebt 3. Asked for all info about me under the DPA etc I received loads of stuff today from GoDebt, under 1, above, but they won't give me any info about the debt assignment, and want a tenner for the DPA stuff, which is fair enough. I've never seen the Notice of Assignment they refer to, nor any further correspondence from DFA/YCC after the date of auction. I'm confused as to what I'm actually liable for. Under the CCA Termination bit, a figure of £4700 odd is quoted as being the amount I must pay to terminate. However, GoDebt is demanding £5700. Which of these figures is probably correct, or is there a 'get out' clause as I terminated voluntarily??? In any event, I don't have that kind of money to pay, so it'll have to be monthly repayments...! As an aside, within the reams of paper they sent me, were five pages titled Notes by Deal No, which have short-hand comments when I made contact with them. There are a lot of blank entries on certain dates, making me think they've been deleted, and the abbreviations they've used make it near impossible for me to understand what's going on. Can I ask for a proper transcript?? Any help/advice appreciated! TIA Jb |

hell Joybringer, welcome to our forum. You are liable ofr payments up to the half way mark of your agreement. As you VT your car after one month you will be liable for 23 months instalments. Also I'm afraid the mechanical breakdown insurance. What was your monthly payment? |

again Joybringer.Godebt show alot of interest in people they chase who own property. Unfortunately they still persue you for bankruptcy even if you have nothing. I think your first step here is to seek some legal advice over your agreement. Your first port of call should be the CAB. They will check your contract out and see if you have a challenge to it. There are a number of legal arguments against the YCC contract that have caused the likes of Godebt to step down from their threats. You ned to find out if you have a case or not. At present from what we can see you are liable for about £4700. You will incur expensives if Godebt make you bankrupt. So you really need to find out if your contract is enforceable or not. |

As Baked has posted contact CAB now! ask to talk with the in house debt advisor who will contact the special support unit - they are well ware of Godebt practises with YCC cases and should be able to halt any bankruptcy proceedings. Don't just leave! get intouch with them today - agree nothing what so ever with Godebt before you speak to them. On a seperate issue, have you received any letters from 'Hollis Briggs' solicitors - the legal firm , all part of Go and Geldards. Hi. Thanks for the replies, peeps. I should make it clear that I've only just heard from them, and intend to follow up on your advice, and talk to the CAB, but I haven't been threatened with bankruptcy. Yet! I wanted to know if they are amenable to discuss monthly payments, whatever amount I am liable for. If so, what's the best way to go about it? I've just received the CSA and a few other bits from them, but that's all, so far. My disposable income is very low, due to divorce and other debts etc., so I'm looking at offereing a very small repayment figure - probably less than £50 a month, probably nearer £10!!! Before I start panicking, I wondered if anyone has similar circumstances and experience of making offers etc. I can provide them with Income and Expenditure / Budget statements etc. I'll make enquires with CAB and National Debtline on Monday, and keep you posted. First of all JB go to the CAB and get advise. If you dont have a case then the CAB will talk directly to Godebt about the debt. The Managing director of Godebt use to participate in this site and did say they do talk to the CAB. Also he did say he is willing to talk to our users. |

Hi this is my first post. I have dealt with Go debt, after I returned my car to YCC showroom due to ill health, i was told that they would sell it for the outstaing amount which was about £2200. I later received a letter fro DAF saying I now owed £4600.I was quite ill around this time and having chemotherapy so I decided to just ignote DAF, (its worth telling you that DAF were fully aware of my condition and the reason for returning the cars WITH YCC permission). 6 months ago I had a letter fom GOdebt. By now Iam completely fed up with all this so I rang Godebt and spoke to a lady who did give me her name, when I explained all the above and that I had no income due to my illness (I get just my pension, I am 68) she said what could I afford each month, I answered £1, she asked if I would be able to manage £2. no I said I cannot, OK she said I will have to put it to the Directors, I said put it to who you like, thats my offer or we go to court and I will instigate the proceedings. Two days later I had a letter agreeing my offer, to be reviewed in 6 months, I have just renewed it at £1 again. I hope this helps and encourages you all. Cooinda |

Hi again. Thanks for all the help. The current situation is, I've been phoning my local CAB, every day, every 15 minutes, since Tuesday, and still can't get through. The nature of my job means I can't get there during the restricted hours they open. To say the least, I'm fed up!!! Any suggestions?? Secondly, I sent a £10 PO for the Subject Rights Access, and GoDebt (Alyn Thomas) replied that it's now been passed to their solicitors (Bill Gill of Hollis Briggs) to arrange the information, and that all future correspondence should be directed to them. I'm not sure what this bloke means - all correspondence, period, or just regarding the Subject Access Rights Notice?? Help!! Thanks Jb |

Apologise JB for missing your post. Bill Gill will be the person who you will have to deal with regarding your issue. He should handle your SARN request as well. At least you now have proof that they have received your SARN. I know of one user on here who claimed his cheque was cashed but never received any information. This user then e-mailed the MD William Rhodes who in return ignored his e-mail. Then they have 40 days to comply with your request. |

JB, Before you contemplate talking to this user make every effort to contact the CAB or our partners Stephenson solicitors. By arranging a payment plan with this company can be taken as a confession of owing the debt. As we have mentioned all over this forum there are a number of legal arguments that are causing this company to set aside their threats. The chances are your contract just might be unenforceable therefore you will not be liable to pay. It would be best for you to find this out first before comtemplating the above offer. |

Mr Rhodes, thanks for your feedback. I don't acknowledge GoDebt's claim, and I am seeking professional advice. However, if the claim is proper, and it means I am actually liable for something, I would welcome the opportunity to discuss repayments, as you've kindly offered, either personally, or through my agent. I will keep your details on file. As an aside, and for information, why is it necessary for GoDebt to pass everything to a firm of Solicitors, when all I've requested is details of all the information held about me? Thanks, Baked. I don't acknowledge GoDebt's claim, hence the need for CSA and SARN stuff. I can't see the rationale or connection between asking/providing information under SARN, and assigning debt collection to a solicitor. All sounds very threatening to me, unless I've misundertood Mr Rhodes' comments... I certainly don't acknowledge the claim, and as soon as I can actually get hold of CAB (still trying every 15 minutes, and no-one's answering the f-ing phone!!! Grrrrrr!!! This has been going on since Tuesday!!!!!) I'll ask them to take it up if appropriate. If not, I'll talk to Stephensons. Thanks again Jb |
