Hi - long story - had car with YCC returned it after having paid +/-£7000 (car cost +/-£9000), so well over 2/3 mark as was wrongly advised by their previous debt collection agent. Been harrassed by Go Debt for some two years now, have dealt with just about everyone in their company, have written to them on NUMEROUS occassions, saying NOT PAYING, GIVEN CAR BACK. We have recently moved house (I rent), so have also not given them my new address but they have my mobile contact number. Was contacted today I would not give them my new address or phone number, was told it says on my file "NO SATISFACTORY ARRANGEMENT AGREED" they also stated that I have not contacted them which is rubbish. was also told that they are giving notice that they need a letter from either my solicitor or CAB within 14 days and they will be charging me. What I want to know is am I obliged to give them my new address? They never put their calls into writing anyway they only ever make contact via telephone. Any advice please. |

what do they want a letter from the CAB or solicitor for? do you have copies of the letters you have sent them? is it just the insurances they are chasing you for then? the thing is if you don't give them your new address this will look bad for you and they may start harrassing anybody you put down as a referee. who was the debt collectors before and do you have any correspondence from them? were you told by them you owed no more money when you handed back the car? do you have this in writing? |

Hi - I cannot remember the name of the original debt collection agency but the car was collected by a company called DLC. I did not know my rights etc then so was very much intimidated and felt there was no option but to hand the car over. I had a written agreement with YCC to have my payments reduced which I was paying but they handed me over anyway, still do not know why, the agency said it was because I was in arrears, I explained I had a letter agreeing payments but they said it was not relevant. Some of the repayment is for insurance and also included is a charge of £235 for collection of the car which I know does not have to be paid. I have loads of letters I have sent Go Debt as this contacted me in February 2005, also loads of letters from Go Debt changing the amounts they want me to repay, I think I have 4 different amounts. My arguement is that have paid over £7000 which only leaves a balance of about £1500 which is well over the 2/3 repayment clause. I do not understand why they need a letter, I think it is just a scare tactic as usually, they are extremely good at intimidating people my first experience with them was horrific I ended up in tears. I just want to know why I should send them a letter, seems a bit strange? |

This is one I can't understand either unless they want to see an income and expenditure sheet to show what you could be paying a month. As you say though if you have a letter from DAF to say you could pay reduced payments then this should stand and it should never have been passed to a DCA. Did you default on these payments? I would get to the CAB as soon as you can and ask their advice. Like you said if all you owe is £1500 for the insurances, this is all you should be paying. The £235 you quote do you know what this is for? Most people are only ever asked to pay an £80 collection fee (although this is not legal either) but how can they justify £235? |
