Hi,

I have only just discovered your site, I actually gave my car back to yes
car credit after 2 years as I could not afford the car anymore with a promise
that I would only owe £1,000. However they informed me that I owed them £3,000
and are still chasing me for it.I re-pay £20 a month they are threatning
court action where do I stand?

hello and welcome to the forum Bev.

right first things first, have they given you a breakdown of this £3000 they claim you owe?

you say you gave the car back at the 2 year mark - were you in arrears at all when the car went back?

do you know what the figures on your agreement were eg the amount you had to pay; what you paid every month and what you paid for insurances?

you say you pay £20 a month - is this an arranged fee with YCC and if so do you have written proof of this? how long have you been paying this £20 a month for? would an income and expenditure form clarify that £20 is all you could afford?

what I would do is keep paying the £20 every month and if you do not have any of the above information send YCC a DPA request (a template for which can be found on the forum) and ask for copies of all information they hold on you.

if it went to court and you had been paying them every month since giving the car back and this £20 was all you could afford then a judge would probably look more favourably on you.

please let us know the answers to these questions and explain a bit more about your situation with YCC and who is threatening court action and we can give you some more advice
